Do not ignore this notice letter

Hi All
I got a Parking Charge Notice. When I was visiting to do some work in one of the flat. The car park have a sign inform it was a Private Car Park, so I looked around to see where to car but the was NO sign inform where visitor could park.
The was some very small number on the kerb stone around the car park. But the numbers are not in any order and a LOT of them cover in leaves and some numbers had been rubbed out.
I tried to find an area where I could park but was unable, so I decided to park in the flat I was visiting (25) but again a was unable to find the number. All this had taken up time and I needed to get the job done so I parked next to bay 24, hope it was 25 bay the flat I was visiting.
I have visitor the car park again and walk around the car with the flats caretaker and neither of us could find bay 25.

I have appealed to the company (Link Parking Ltd) who turn it down, I also appealed to IPC who also turn it down.

I have just had a NOTICE TO KEEPER Do not ignore this notice letter now asking for £100 and if I don't pay it the 28 days in full. the case will then be passed to Debt Recovery Agent which may escalate to court proceedings to recover the amount owed and the charge will increase to £150.

Can they go to Court without out me knowing? and should I just pay up and give in?

    and read the debt collectors post (4) in the NEWBIES sticky thread above this one

    also ignore debt recovery too

    only deal with an LBC or an MCOL from the SCC

    They can take you to court, but are unlikely so to do as this is a private block of flats and there has been no loss.

    Get you employer, presumably, one of the owners of the flats on side, and ask him/her to have the managing agents cancel the ticket. The purpose of a PPC in a block of flats is to make life easier for owners and tenants, not harass them or their workmen.

    Also, was this a contractual charge (as opposed to a breach of contract)? If so did they send you a v.a.t. invoice? If not, ask for one.

    To be honest, even if you had found a visitor space, Link Parking would still have ticketed you and sent you one of these speculative invoices.

    The IPC's appeals service is a complete sham, which hopefully will result in the DVLA removing the IPC's accreditation if they receive enough complaint, so I definitely suggest emailing the DVLA to complain about them releasing your details to a company belonging to an ATA without an independent or impartial appeals service.

    And no, they cannot go to court without you knowing (as long as you don't move address without forwarding your mail, or anything like that!) You might get another chaser letter from Link Parking next, which you ignore. Then you might get a debt collection letter from Gladstones Solicitors which you can ignore. Then you might get a Letter Before Claim from Gladstones Solicitors (it will say "Letter Before Claim" on the top of the letter) at which point - come back to this thread for advice on how to proceed. Worst case scenario is that they do end up taking you to court, but with the help from people on this forum you'd stand an excellent chance of beating them. Even if you didn't beat them, you wouldn't have to pay much more than the £150 they're trying to get out of you now, and you wouldn't get a CCJ if you paid up. But you probably wouldn't lose, and it probably won't even get that far. :)

    So definitely do not pay!!!!!!!!!!

    Do I pay/ignore. Do write back to the solicitors.

    unless its a letter before action saying they ARE going to start court procedings , not "MAY" then file it with the rest


    expect another one in a week or two offering a reduced price , then in another few weeks even cheaper , then in ,,,,,,,,,,,, and still ignore.


    let them take you to court , ask for the adjudicator from the IPC to turn up as you want to ask him some questions regarding his answers




    I have a funny feeling they will not show in court.




    PS: check the address of Gladstone solisitors and that of the IPC , notice anything , yup its a kangaroo court and they are just frightening you.


    with POPLA your claim would have been accepted and they would have had to accept the outcome , with this other mob , its just young fred the office boy that says "declined"

    OK, so a director of Gladstones is a certain Mr John Davies. Now guess which other company he is also a director of ? ........... ah yes, the IPC Ltd ... the very people you had to lodge an appeal with. Allegedly they are independent :rotfl:

    So the (dis)honourable Mr Davies get's paid by the PPC to look at your appeal and then gets paid AGAIN to chase you for payment after he has thrown out your appeal. Of course no conflict of interest is there .... oh no sirey !

    Scumbags and criminals the lot of them. Just ignore everything you get from them unless it is REAL ( they have been known to send fake ones ) court papers.

    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:
