IAS Appeal failure - past appeal date

Hi
Firstly a big thanks to all for the great advice on this site.
However after wading through umpteen threads regarding PCNs and reading dozens of cases etc etc I came across the PCN flow chart.
And so here I am now seeking guidance as to my next course of action. My case is a little complicated but I will try to explain as best I can

I received a PCN from London Parking Solutions. It was dated 30+ days after the alleged event.
I spend long periods abroad and all my post is redirected to my letting agent, who opens the post and scans and emails anything of importance to me. This usually happens with 1 to 2 days of receipt at their address.
I therefore received the PCN via email from my letting agent, to which I drafted an appeal based upon the various threads on this site. The basics were GPEOL, and schedule 4 POFA of NTK not being complied with.
I then received an email from my letter agent with a copy of the appeal notification, and surprize surprize it was dismissed. The letter also gave IAS details and 21 days to appeal. The appeal letter was dated 20 days before my letting agent received the letter via the post!
I then wrote to IAS asking for an appeal based upon exceptional circumstances i.e abroad at the time and the tardy dispatch of the appeal notification. I supplied a PDF of my last trip to Europe and a signed statement from my letting agent regarding receipt of the appeal notification.
And yes you've guessed it - exceptional circumstances were discounted.

So my question is:
What is my next course of action

Thanks for all the good work you're doing

If you have appealed to the PPC and appealed to the [STRIKE]kangaroo court [/STRIKE] IPC you have done as much as you can. You have cost the PPC money even though you lost, and all you can do now is ignore unless you get a LBCCC or real court papers.

  • Thank you for your prompt reply Fruitcake - it is much appreciated

You have confirmed my initial thoughts on the subject.

I had thought of also complaining to DVLA regarding the biased approach of appeals process - would this be useful?

Yes, 100% complain to the DVLA. It really is an absolute disgrace that they have allowed the IPC to become accredited given its clearly biased, anonymous, unprofessional "adjudications". We need the DVLA to get bombarded with complaints to make them take notice.

I wouldn't worry about missing the appeal 'deadline'. They would have found some other nonsense reason to dismiss your appeal if you'd appealed in time so it doesn't make any difference.

Ignore everything now except for a Letter Before Claim or court papers.
