To be honest, I would more argue that it sucks to be him... its a pain in the aśs when some kind soul reverse into your car when you were otherwise minding your own business.0 -

Fair point, thank you for putting it so gently
So regarding damage to the vehicle; if it's already been paid for, repaired, and dealt with outside of insurance companies, will he be able to still make a claim?
If he does, is there a time constraint on when he can do this? As this happened a couple of weeks ago.
Basically I am trying to find out that if he want's to take me for a ride, how far can he go, what's the worst case scenario?
Thanks.0 -

And then goes looking for a loophole to get out of it
On point 1. re: comprehensive cover providing 3rd party for other vehicles, age might come into it. I know lots of insurers only provide this cover now for over 25's to stop wee kiddies crashing daddy's car etc.
Still doesn't change the fact the OP is 100% liable mind.
Also, I am pretty sure OP that exchanging details at the scene doesn't mean that you need to be so cagey and tell him to use your reg plate. For me, it looks like you are the dodgy driver (I know you aren't but see no reason why you wouldn't have just said "I'm with ABC insurance")What if there was no such thing as a rhetorical question?0 -

Sorry, there is a misunderstanding here I think. I became sceptical because he wouldn't provide his details, but asked for mine. Besides, if it's any consolation I was quite polite about it0 -

If you haven't paid him yet, I would type up some sort of form for him to sign accepting that the payment offered to cover repairs to their car is in full and final settlement of the accident and they agree to not pursue any further claim in terms of repairs to their car or personal injury as a result of the accident in question. Print 2 copies and ask them to sign both. You keep one and he keeps one.0 -

I've already been warned from calling someone a muppet :A
Law of limitations give 3 years for injury or 6 years for property damage
Worst case is it gets passed to your insurers to deal with and you lose NCD if it isnt protected. There is no excess to pay for third party claims so given no damage to your vehicle that costs you nothing.0 -

When he asked for my details I advised him to use my licence number to get the information (I wasn't about to share info like that yet)
My head hurts...
It's obviously your fault, and you accept that, but you want HIS insurance details? Why? And you're "suspicious" because he hasn't got his to hand, but you're refusing to give him your insurance details, the only relevant ones in the whole saga?0 -

seems to be an echo in here...
OP, as gazfocus said, get a receipt typed up for full and final payment if it is going to stay off the insurance. They (your insurer) need to know anyway (if they don't already). What if there was no such thing as a rhetorical question?0 -

Swapping insurance details is standard, even if there seems to be no damage on initial inspection right?
As above, when we went to swap details, he refused to give me his. Not that he didn't have them to hand, but instead when I asked him for his details he said "No, speak to her about that" pointing out his girlfriend. Then when he asked for mine, I suggested that he refer to my number plate and gave him my name whilst I proceeded to address his girlfriend.
It's not as though he asked for my details and I said no. I know I'm a pretty cynical person but I also think it's entirely reasonable to be careful when someone refuses (and he did refuse) to give me insurance details.
Also, I'd like to recognise that the fault is mine only from the classic perspective of the insurance company. Truth of the matter is; I was pulling slowly out of a parking space, the adjacent parking space had a van in it (making that side blind) and as I pulled out he came speeding around a corner and right into my way. I even have him on video doing easily 20 in a car park. Probably why he was so amiable about the situation.
Don't know if it's just me but I kinda feel like people think I'm inconsiderate at best, dangerous at worst. It's not like I put the car in reverse and sped out.0 -

This is why you should reverse in and drive out.
No matter how fast he was going, you pulled out and couldn't see enough in time to stop. Sorry but you clearly weren't going slowly enough.
Nothing to do with the insurance. The only perspective is it is your fault. Try to get it sorted before an ambulance chaser calls him! What if there was no such thing as a rhetorical question?0
