Changing house deeds from joint owner to Wifes

Hi all,

My soon to be ex wife is buying me out of the house we currently own together, all very amicable so far. We have agreed a price and a date for me to move out, just need to amend the mortgage and the house deeds.

We have made an appointment with the mortgage company thats all fine, so my question is with regards to the house deeds.

We want to keep cost down to a minimum, we have agreed everything all we need to do is just get the Deeds signed over into her sole name.

Does this need a solicitor to complete?

    If there is a mortgage, the mortgage co will insist that a solicitor is involved.

    As you probably appreciate, affordability for the original mortgage was based on your joint incomes. So the mortgage co will now want to assess whether your wife's income alone is sufficient. And their lending policy may have changed since you first took out the mortgage.

    And the lender will want a solicitor to make sure on their behalf that their interests are protected as they still have a mortgage on the property and they will need to sign a document consenting to the transfer.

    As edddy and Richard Webster have posted if the mortgage is being changed then the lender will insist on legal representation etc
    As you are likely to also need the lender's consent there is no real way round this.
