"In this case, the driver appealed and provided supporting evidence, so the parking charge has been cancelled."

However those that simply paid we have trouser'd the cash!

It's appalling that they have the brass neck to require appeal and supporting evidence when it is clear major congestion was evident, especially given the time of year - and people would be caught up in it.

The right thing to have done, in the season of goodwill, was to have suspended their activities for the period. No one would need to be pre-informed, so there would be no planned 'abuse', just the signs and cameras would be enough to concentrate the minds of any potential rogue parkers.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Next we'll have a ""Broken Down""" car blocking exit courtesy of PE. Only need to be there an hour then they move it to another park.

Parking Eye have already been told by a judge that this is unacceptable

This matter should now be reported to Hull Trading Standards, (who have form for prosecuting PPCs)

As for those who pay up, well, they would probably waste it on bingo and scratch cards anyway.

Stunning example of car park management.
Worth sueing for losses caused by their failure to manage the traffic in the car park?
  • Parking Eye only manage their profits never car parks.

Just take a look at the surfeit of small print on Parking Eye's signs . In effect it says that they are only employed to issue their fake fines and all other aspects of car-park management are nothing to do with them.

Easier solution on that site is to park in Asda's car park. Still monitored but only by not so smart.
  • there's some baloney small print in the Parking Eye small print about "entering the land for whatsoever reason," but as The Judge said, waiting for a space 'aint parking. (And even if it was, he'd find it difficult to justify ninety quid as a pre-estimate of loss.)

Keep smiling, what's this about trading standards ??
