Re your question of whether, if I overpay someone, they should be entitled to keep the money: too right they should if it's my careless, negligent, or silly fault that I overpaid them in the first instance. I'd deserve to take the loss!
Archi Bald: I think it's a bit harsh to assail Ludmilla58 with the proposition that she a) accuses the Halifax of theft or b) that she suggests that there are 'spare' funds due to the Halifax having stopped the cheque for £8500. It was I who suggested that the Halifax will probably reward its executives for the organisational incompetence that led to the overpayment (and frankly unless it can be evidenced that all of the media reports over the last 7 years or so regarding bonuses paid by financial institutions have been wholly unfounded, unsubstantiated hype, then I for one do not believe that the existence or otherwise of spare cash within an organisation has much bearing on whether or not bonuses are paid or warranted).
Also, with reference to your penultimate posting, I'd like to clarify that, in my original posting, when I referred to contracts entered into by Ludmilla58 I meant the contracts she entered into that incurred expenditure of £1100; not any contract she had with the Halifax. With regard to the FOS: I have no knowledge or experience of the reasons they might make an award, or of what amount any award may amount to. But with regard to civil action through the courts my point was not that Ludmilla58 should now contemplate such a course (for the simple reason that in awarding the £1100 compensatory payment the Halifax has done precisely what a court would do); rather, my proposition was that the Halifax has done no more than its legal obligation. Had the Halifax not reimbursed Ludmilla58 for the sums she expended in reliance of having received the cheque for £8500 I believe she would have had sufficient argument to pursue the matter through the county court, with a reasonable prospect of success.0 -
