Potential chancel repair liability

The searches revealed that property I'm buying is in "potential chancel repair liability" area.

Now I understand that from 12 Oct 2013, unless a parish interest is registered with title deed, new owner can't be held responsible for chancel repair.

Am I correct on this?

Also, how do I exactly know whether an interest has been registered at property?

PS: I'm waiting for my conveyancer's feedback as well but I think a forum opinion might be useful.
Happiness is buying an item and then not checking its price after a month to discover it was reduced further.

  • My understanding was the same as yours when we bought our place last year. Our solicitor recommended taking out the insurance (permanent, attached to the house) which cost a whole £15. We just paid up for ease of, well, everything...

Where did you get the insurance from?

    Hi movilogo,
Your conveyancer or solicitor should be able to advise and source an appropriate policy for you to sign - at least that's what mine did. The premium is very small in the grand scheme of things.

My understanding is that any potential liability cannot be enforced
if the this liability has not been registered on the property deeds before the first sale of the property that occurs after the 12 Oct 2013.

Through our solicitors, who arranged it.
  • I’d still insure personally!

Just pay the £15 for the insurance. My solicitor arranged mine at this price.

Here are a couple of links to blog items posted by us over the past year or so which may be of interest although you should follow your legal advice

Overriding interests deadline isn't the last word and
    Chancel repair liability still reigns

If you want to check whether the interest has been registered then you would, just like your solicitor will, check the land register
