Gallagher Retail Park Dundee PCN

Hi,
My wife was out this weekend with our 4 year old son and parked at the Gallagher retail park, in the evening and on the way home.
Our son wasn't feeling the best and needed a toilet stop, so she parked outside Matalan, rushed him in and used the facilities.
I was not with them, I am the registered keeper of the vehicle but not the driver at the time.
She then forgot to go back out and get a ticket and spent around 30 minutes in the store.
She came out and was met by the attendant to whom she explained her situation and was told to go and get a ticket!
She did this and left very upset and confused.
We have a time stamped receipt from Matalan to prove she was a patron of theirs while parked and parking ticket receipts for other car parks used during the day, including one which shows she paid and left a car park, less than 2 hours before the PCN was issued.
My wife wants to write and appeal the case with the supporting evidence.
If we go through with her actions what are our chances if we lose the appeal and then ignore them?
Has the law changed with regards PCN's in Scotland recently? Is the Newbie stickie, current and up-to date for Scottish law?
Should I complain to Savill's the land owner and to Matalan, giving copies of the evidence referenced above?

As this is Scotland, the best option is to ignore unless you receive court papers and never reveal to the PPC who was driving in any correspondence as only the driver is liable in Scotland and unless you tell them, the will never no who was driving. You might also want to edit the OP.
Have a read of the newbie thread as well.
You can complain to the Landowners and Matalans at the same time.0 -
Savills aren't the Land owners they are the Managing Agents. You can complain to them though.0

Isn't this the site where UKPC have issued a few trial claim forms, none of which have actually come to anything?
Might be better to POPLA this one, if they're offering it. I know POPLA is supposedly England and Wales but I'm sure they have stated somewhere that they'll happily deal with appeals outside of there. Or have I misread that?Je Suis Cecil.0 -
Sorry Manx but you're wrong in this case - this is Scotland so POPLA doesn't apply because POFA doesn't apply, and the need for an appeals process is enshrined in POFA.
OP - just search this forum for Gallagher ... there are loads of threads about this location. And most importantly ... IGNORE, and do not contact UKPC in any way, shape or form.0 -

They may have "encouraged" people in Scotland to contact them but that would be the wrong thing to do.

It is - They chickened-out totally.
But not POPLA for Scotland, they simply have no remit to operate here.

A close friend of mine received a ticket whilst nipping into Matalan for a similar length of time to your relative and got a ticket back late last year. They've received loads of postal correspondence and have just ignored it without acknowledging anything to UKPC and plan on continuing their silence.0
