Parking Eye Ticket

Hey guys!

Hope you are all well.

I have been sent a letter by Parking Eye requesting payment for parking in a hospital cark park and I am unsure on where I stand legally.

I had an appointment at 13:00 that was delayed by 30 minutes, which I found out roughly 15 minutes before I arrived to the hospital. Upon arrival at and due to the fact that my appointment was delayed, I sat in my car from 13:00 to 13:30. At 13:30, i decided to purchase a ticket that covered my stay for 3 hours.

I had my appointment at 13:30 and left at 14:00.

I paid for a ticket for three hours and they are claiming a charge for this due to the fact I arrived at 15:00 and didnt purchase a ticket there and then. I am restricted to move due to health problems so I had to park close to the hospital and wait. I would accept this if I hadnt purchased a ticket, but I was there for one hour, and I paid for three hours, so the company are not at a loss at all from me being there.

Lucky I held onto that ticket!

Could you give me some of your thoughts on where I stand and if you deem this as fair. I have written an appeal explaining my circumstances.

    Your circumstances mean absolutely nothing when it comes to challenging this.

    You obviously haven't already so your next step is that you need to read and digest the 'NEWBIES' sticky thread at the top of the parking board, this will tell you exactly how to deal with this step by step.

  • I have read the newbies thread, but it still hasnt given me an answer to my actual situation.

    Does the fact that I paid for a ticket (which I have proof of in a hard copy) mean they arent at liberty to pursue this charge?
  • unfortunately i have already sent off an appeal before reading this thread explaining what happened so i think I have shot myself in the foot.

    If they send a refusal, shall i then proceed to write back with this letter? Surely if the letter in the thread is being used over and over again, then someone like Parking Eye will be wise to what is going on?

    If they refuse they have to (and will) send you a POPLA code then you send the POPLA winning words. PE are well aware of cases written by forum members but they can't beat us at POPLA so have given up contesting those ones. They are 'wise' to it but can't do anything about it - and they are not bothered about it as we are a drop in the ocean. The POPLA appeals they do contest and win are those written like you have, about what happened, as they still win plenty of those. POPLA is NOT about saying what happened, it's about contract law issues. Silly isn't it?

    Don't panic, just be ready to beat them at POPLA over there being 'no GPEOL' if they reject.
