Didnt send evidence...what now?

Hi all

So in November i parked in a Mcdonalds car park and had problems with my car, had gone through drive thru then decided to stop for 5 and eat my burger before driving home to be safe, but as had had problems with the car it was playing up, smoke started pouring out of the bonnet, temperature shot up to max and i couldnt go anywhere so i went over the allowed stay time (which i was unaware of). I then drove home once it cooled and next day topped it up with water and drove it again planning to go to a garage and get it fixed asap but broke down, and had to call out the AA to repair the heater matrix at the roadside. I have paperwork proving this.

Parking Eye contacted me with a parking fine which i replied to challenging advising of my trouble with my car, they then responded asking i send evidence to support my claim, unfortunately i forgot as had a lot on and went into hospital shortly after their letter came through the door and have been recovering since so now i have found the letter and am wondering what will happen next.

The letter asking for evidence was dated the 5th December 2014, and said i had 14 days to sebd evidence... However it is now 37 days since the 5th December.... And i havent heard from them, are there any rules stating that i now dont have to pay anything or that i have to... Etc can anyone help please???

Im quite concerned that they will make things worse. And have heard so much about them being parking cowboys!!!

    err, no they didnt , they sent you an unsolicited speculative invoice, no firm is allowed to "fine" you , it will not have contained that legal word on any documentation either

    they have up to 6 years to pursue this invoice ( invoice , not fine )

    my advice is check their online website and see if the charge is still outstanding

    the BPA rules are that they "should" make a decision within 35 days of your appeal , so if you have sent any evidence then say 35 days after that , if its still oustanding, scan the evidence and upload to their appeals section of their website, or post by snail mail with free certificate of posting at the PO

    Another easy one to answer, already covered umpteen times on the forum every week. Obviously you complain to the BPA that PE delayed and faffed about and never sent you your POPLA code following your appeal, which they acknowledged and replied to, so you know they had it.

    I seriously hope you didn't go and tell PE who was driving the car, in that 'appeal'? You called it a 'fine' (nope, it is NOT) and you called your appeal your 'claim' (it's not a claim!) makes me think you don't fully get the issues yet and have not yet read how to win at POPLA stage. This is sooo simple and is all covered in the 'NEWBIES PLEASE READ THESE FAQS FIRST!' thread near the top of this forum. Please read it, post #6 about complaining to the BPA and post #3 about 'How to win at POPLA' when you get that POPLA code.

    DO NOT ignore this - PE sue people who don't go to POPLA.
