POPLA Query

Hi

i sent my popla appeal off on the 3rd December. The decision date is the 21st Jan.
POPLA reply said i should receive papers from the parking company (LDK) to which a rebuttal to their rubbish was going to be sent in.

I haven't received anything yet from LDK and i think i should have by now.

how / who to do i complain?

    They might not be defending it?

    You still have a week or so yet.

    Might be worth contacting POPLA to check. Loads of PPCs send in evidence, and don't bother sending it to the motorist, even though they declare to POPLA that they have.

    Scumbags.

    There are some that don't defend at all however, as Dr Shoe indicates. You never know.

    Just had a reply from POPLA

    they have not recieved any evidence from LDK.

    is this normal?

    as in will LDK submit at last minute, so i cant rebut?

    or it is possible they wont bother defending?

    they may try, BUT you have to receive a copy too

    so if you hear nothing, its likely they have done nothing

    just be patient and prepare any rebuttals for their last minute "defence"

    It is now a week past my decision date and heard nothing.

    Phoned POPLA and they said they cannot tell me whether or not any evidence has been submitted.

    surely this isn't right?

    If evidence has been submitted then surely i have the right to know and should have received it which i haven't.

    any advice?

    yes, patience, as there is nothing you can do about it, it will all happen when it happens, there is no magic pill to speed up the process, its out of your hands

    stop worrying and come back when you have some actual news , either their rebuttal for you to further rebut , or the actual popla decision
  • Although it’s probable that the PPC won’t bother to submit any evidence to POPLA, there’s no harm in sending an e-mail to [EMAIL="appeals@popla.org.uk"]appeals@popla.org.uk[/EMAIL] along the lines of.......

    "Dear POPLA Appeals Team

    POPLA Verification Code 0123456789

    With reference to the above-detailed POPLA appeal and in follow up to your notification that the Operator would send me its evidence prior to my POPLA hearing scheduled to take place on or soon after 21st
    January, I write to advise you that I have received no communication from the Operator in this respect.

    It is possible that the Operator may have already sent you its evidence and it may simply have been an oversight that it did not also provide me with this. If this is so, then I should be very grateful if you would send me a copy of the Operator’s submission as a matter of urgency.


    Alternatively, if the Operator has not provided you with its evidence, please let me know by return. Although I would be very disappointed to learn that the Operator had failed to engage in the arbitration process, if this is indeed the case may I assume that my appeal to POPLA is upheld?

    I look forward to hearing from you.


    Yours faithfully”

    If nothing else, this establishes a written record that you have received no evidence from LDK.

    agreed, so if wanting to "do something" , do the above , in writing , create a paper trail of evidence that cannot be challenged down the line
