Disabled Bay UKPC Parking Ticket.

Hi.

First of all i would like to thank you for taking the time with this.
I understand that there is a newbie and i have looked and have seen the appeal letters but as this is slightly different as i was parked in a bay i thought it best to ask first. (Apologies if this upsets anyone)

Briefly, I received a windscreen ticket for parking in a disabled bay without clearly displaying a permit.

I do have a blue badge and also a disabled tax disk.

Now although i did not put my Blue Badge in the window it was on the passenger seat as it slips down the gap between the window and dash ,also previous occasions i have asked wardens if it is ok to do this and i have always been told yes.

It was issued on the car on the 8 dec 2014 and i have today received a NTK.

I have contacted the carpark who were very dismissive and told me to take it up with their contractors but as of yet i have not contacted UKPC. This is in main because i didn’t want to “!!!! it up” by sending a letter i should not have.

Also i have looked at their site and it has the pictures of the car on. The pictures are horrendous to say the least and it is so dark you can only just make out the reg. He also looks through the passenger window and takes a picture but not of the seats where the badge is.

Please help if you can.

    the BB isnt valid for private land (check the blue book)

    what is valid is the EQUALITY ACT 2010 which both the landowner and this ppc are jointly responsible for , you have done nothing wrong so should not be hounded in this way , those spaces are provided by law for you and have been for a very , very long time

    if you have the postal NTK, appeal it using the template letter in the newbies thread

    also get back onto the landowner and quote the EA2010 (riot act :) ) at them, telling them that unless this is dropped you will look into a counter claim under the EA2010

    so focus on the EA 2010 , not the BB

    if you havent had the NTK, wait until it arrives , but as you seem to have received the NTK, use the template appeal and also re-complain to the landowner with your EA2010 rights

    also bear in mind that some photos are ANPR and so will be dark with only the reg showing

    pps:- tax discs are no longer valid and havent been since oct 2014 (they no longer issue them) , neither do they prove the entitlement of the person who parked the car ( unlike your BB which does and has your name and picture on it )

    Thank you so much, i will rally the land owner again and read them the riot act and see what they want to do.
    I still have 28 days so will appeal with the newbies letter to get some more time and hopefully the land owner will see sense and drop this.
