Hi All

Ive checked my CRAs with all recently and noticed that i had a live Barclaycard Account running through NODDLE. I disputed this 2-3 times and stated that the account was closed back in 2004 too which they responded stating that the Barclaycard has confirmed this isn't the case and the account is still live :eek: Ive written the the FOS in the mean time regarding the response and today Ive received a letter from Barclaycard today stating that the account didn't close in 2004 as i originally stated, BUT a letter was sent out by Barclaycard in 2004 stating the account is now SETTLED was an ERROR, And that when i later entered an IVA in 2008 that was the last correspondence Barclaycard has had from me and that's why the account has stayed live:eek: Barclaycard have asked for an IVA completion certificate too which i don't have as the IVA failed 4 years into it and they can look into it in more depth of an outcome, and by the way here is a £50 cheque for the inconvenience caused..

My questions or answers im looking for are- Do i contact the person from Barclaycard and state how can you send me an account SETTLED letter then in 2008 the account went into the IVA which failed and ive never received any debt letters nor credit card statements from them just finding out by recent findings on my CRAs ???

Or do i leave this in the hands of the FOS who will investigate on why they sent me a SETTLED letter in 2004 and then kept scoring on my CRAs until this present day ???

Or do i state to Barclaycard that i would like the account to become active with a balance of £1700 and use the account too my needs ???

All or any advice is highly appreciated in advance...

    Is there a debt still owed on this?

    If so, was this included in the IVA? Do you have paperwork showing that this was included in your IVA before it failed?

    Hi Fermi

    Barclaycard said that they sent me a letter stating that the account was closed, but then go on to say it was put into the IVA few years later on....:mad:

    I think i should ask Barclaycard for the initial credit agreement also any IVA details which if they have i can check, if they haven't any of the above then as far as im concerned what i first thought i paid this account off too which no unveil ill put a case towards the FOS.

    What you think ??

  • Surely the account should have been defaulted when it was part of the IVA, successfully completed or not.

    That stays for 6 years, should have dropped off in 2014.

    Complaint and FOS sounds like the best plan.

    That's why I asked. You don't need to ask BC that, as it will have said on the IVA paperwork what debts were included, but sounds as if BC knew of it.

    If so then the best option would be to complain to BC saying that as part of the IVA they are obliged to have defaulted it in 2008 under ICO guidelines, and it is inaccurate to record it in any other way. Recording the account as default in 2008 would basically remove it from the report as it would be too old to show.

    The fact that they might have made a mistake at some point that it was settled earlier is neither here nor there, as if a genuine mistake that is a legal get out of jail card on these sorts of things.

    Thanks for the responses, so going forward you think i should write a letter mentioning the IVA that started in 2008 and that by 2014 the account would have been closed as 6 years has lapsed and the when the account went into the IVA in 2008 a default should have been issued too which now would be statute barred... ?

    Also on the 18.12.2014 i reported to the FOS and the only reply recieved was from Barclaycard stating whats mentioned in my OP but am still waiting from the FOS investigation..
