If the roundabout was was a "small three way" roundabout as you describe, surely there couldn't have been a straight ahead option for the third party vehicle? There would have been the lane which he approached from, the lane which you approached from and finally the exit leading off from the third party's right?

There could if it is say a mini roundabout placed at what was once a T junction.

Whats the model/year of the car or a rough idea of the value?

How much damage was there? wing, door, screen, suspension?

Were you 3rd party or comprehensive?

Might be time to start looking for another car. If you dispute the cars value you may not get a payout for some time though.

If you didnt have legal protection or a guaranteed hire car then you wont get one. As the incident appears to be your fault your not in a great position.

Might help....i had a similar situation just before xmas, 1st accident in 26 years, i'll probably be put at fault, car written off.

My insurer would only provide a hire car if the repairer was not providing one, which was pretty obvious as mine was a write off so would not be going on for repair. Luckily i had paid extra for a guaranteed hire car, this is provided regardless of fault for up to 2 weeks.

Check with your insurer if you have a guaranteed car hire.

Luckily for us we had been saving for a new car so rather than wait for any payout, which tbh would only be a couple of thousand, we went and bought a new one anyway.

Returned car hire after a week, my insurer have now offered a settlement to me 10/01/15, accident was 22/12/14 and we have accepted.

So thats how my claim played out, underwriter is Covea.

I'd be wary of accepting a car from the 3rd party handler if fault is questionable if they can't reclaim the cost.......

Perhaps if you dont have a g'teed car, just hire a small one its not that expensive tbh.
  • Thanks Wazza99,

It was my first accident in 12 years. I think mine will be written off as well. It's a 2005 Civic and the right hand side wing is damaged as well as the front wheel. It was an old T-Junction replaced by a mini roundabout as some people have guessed. I have been on that road so often. Well, what's happened has happened.

Very true, this mini roundabout, I fail to see that a car from the right could be missed whether indicating or not.

Depending on whether they were going right or straight on, they may have failed to indicate, which would be very annoying for the OP, but won't help, and OP will be still be at fault for failing to give way either way.

Unless you're coming from the opposite direction

  • Thanks for the picture,
Now imagine, I am that blue car coming towards the round about and there is a van to my left coming towards the round about as well. The car that hit me in the same direction as focus but approaching the round about as well.

I would expect it to stop for the van on it's right or go straight if it is expect the van to stop for me. What it did was turn right all of a sudden and hit me.

So he was already on the Island turning right when you pulled out as you failed to see his indication?

Or he didn't indicate. Sucks, but still OP's fault unless there was some massive swerve involves from the other vehicle.
