local legal services ltd

Hi,

recieved a card through the post today from these people with the verysimple wording:

"I confirm I will be calling on"

then handwritten "wednesday"

"signed"
M.McCall

not sure who Mr M is, but local legal services ltd seem to share an office with Computerised debt collection agency who are after us for £60 from books for children, who havn't sent us the goods ordered so I will not pay them.

anyway what is Mr M expecting on wednesday and what rights does he have, if any? I'm guessing he is a doorstep collector, unfortinatly I cannot be at home on wednesday and my wife will be there with our 8 mth daughter, and I don't want her getting upset, if he has no rights will she be ok just ignoring him?

your help as always is much appreciated

    tell her not to answer the door. As far as I am aware these doorstep callers have no rights. I'm sure someone who knows more will be along to answer you shortly.

    Hi there,

    I would also (if you haven't already) write to the DCA (send recorded and keep a copy) setting out the issues you have with the book company and refer the situation (again in writing) to your local trading standards for advice, as this will not go away on its own.

    Thanks, but have tried this but the DCA just want money.

    my wife is just worried that they will kick down the door and take what they want!

    Thanks to Rog, the OFT guidelines on debt can be found at the following link:

    Unless they have a CCJ against you, they cannot enforce the debt.

    Since you have written disputing it they are in breach of other OFT guidelines and should not even be contacting you.

    And even if they have a CCJ they are not allowed in the house unless you invite them in (although they can enter unlocked doors and windows), they have come when it suits you etc.

    Nor are they allowed to frighten you by implying anything that they are not legally entitled to do. And at the moment they are not legally entitled to do anything.

    so let me get this straight, we can legally not open the door to them, they will not turn up with police and will not have a search warrant. long shot, but if the window is open can they climb in?

    will I know if they have a CCJ? not had any letters from a court or any "offical body" just calls from the collection agency saying that will are sending someone round to collect goods?

    If the door is opened can they enter, we don't have a peep hole, or do they need to be invited?.... like a vampire?

    A Debt Collector has NO legal right of entry to your house either by forceful or peaceful means.
    Other than for the purpose of establishing if you are the actual debtor, they should only call at your house by pre-arranged appointment. A card through the door, stating that they will call on Thursday, is NOT a pre-arranged appointment.
    A debt Collector MUST leave when you ask.

    very busy chap this M.McCall....i just got the same card and he's going to visit me this thursday in Central Scotland....and i have the same ongoing issues....charged for goods not recieved or ordered...i instructed them that if someone signed for delivered goods and ordered more to contact the police as this must have been fraudulantly done as it wasn't me...they stopped writing for a while and noe this card :confused:

    I had a card with the exact same wording on from RMA a while back, though they dadded 'between the hours of 9am and 8pm' on mine. At first I thought they meant call on my doorstep, but on rereading it a few times, I took it to mean call on the phone. I believe they deliberately make the wording ambiguous to scare people into responding, I imagine most people would be more likely to contact them again if they thought someone was coming round. Not saying that this is what they're actually meaning by the card you received, but it's a possibility.
  • you could be right on that note....at the top right in bold lettering is their telephone number...it may be this is a note to make you panic and contact them to try prevent someone coming to your door...in this way you will arrange an appointment or arrange to settle

    Well, wednesday came and went with no visit and no call, all it was was a scare tactic to try and get some dialog going! ha ha, well they don't get me that easy, thanks for all your advice guys :beer: for all!
