The Great John Lewis Office 365/Bundle Error

hi all. hukd, last week, featured a 'glitch' on the JL site for an office 365 software package that looked like it offered you the software AND a laptop or computer bundled with it for the tiny price of 39.95, rather than the software for that price IF purchased with the identified computer.

a few people piled in (me inc), just in case...

we received an acknowledgement email, which included the bundled details... we then received a delivery email that confirmed the delivery but was generically written and didn't include the bundle details.

item arrived. noone received a computer! since then, the offending pages have been removed from JL site and some people are hoping for an M&S-sofa-price-glitch result...

what i'd really like to know is, if their T&C states that the contract is agreed only on delivery of item but the delivery is NOT as acknowledged in earlier email, but what was, presumably, the actual sale (the software only) is that going to be JL'd 'jail free' card?

anyone else who participated and knows legal stuff, hoping for a result? and is there any precedent if they state that this was never a deal but a website error? happy to supply further info... now become more of an OU general interest subject than anything else...

You have no chance. They did not send you themistaken item which would have formed the contract.

Sue them. You should get your computer AND a sofa in recompense.

That's not even logical. Basically your saying despite them having the money and op having received some goods no contract with ever concluded between both parties.

Did you take a screen shot or anything op that we can see?

I would say by sending part of the order they have accepted the order, so buyer is entitled to the remaining part of the order.

The zenbook starting price on its own is £700.

A huge pricing difference that wouldve been obvious to anyone imo. I dont think anyone could reasonably claim they thought it was a genuine price reduction.

but contract formed on dispatch, as they sent part of order they have formed contract for everything ordered.

they should of contacted buyer, cancelled order and refunded.

    Dear Customer,

We are writing with regard to your recent purchase(s) of computer software. Unfortunately there was an error on our website and some of the information displayed has led to a misunderstanding of exactly what we were offering under the product description. Whilst the main part of the page displayed the software item(s) that you have ordered, there was also some description of a computer/laptop/tablet. Unfortunately this information was incorrect and, understandably has caused some confusion.

This was a genuine mistake for which we would like to apologise, and accordingly, John Lewis will credit £25 as a gesture of goodwill back into the account that you made payment with and this should appear in your account within 3 to 5 working days.

Please be assured that the item(s) purchased and despatched have been sold to you at the appropriate price. Additionally, should you no longer want the item(s) you would be free to return it as per our returns policy for a full refund.

We are very sorry for the mistake and would like to thank you for choosing to shop with John Lewis.

    Yours sincerely,

    Customer Services
    John Lewis

Look up unilateral mistake in contract law.
