high court writ

Hi,
I had a phone call this morning regarding a debt that has slipped my mind,
He said he was from the sherrifs office and theres a high court writ been isued regarding this debt it just under £5000.

I have no assests im on benefits
If they came into my house they would get about £30 for the tv every thing else is worth nothing,

I tried to arange a payment plan but he was having none of that,

My question is if i have no assets of any real value
What will they do?

    The principle is the same though. They cant actually get blood out of a stone and if you have no assets, then there is nothing to seize. Either they come to an 'arrangement' or it gets referred back to the court who then come to an arrangement anyway. The bottom line is that you have nothing to take and no means to pay their demand. I guess, the first port of call is citizens advice because we are confused over your jurisdiction and whether this falls under Scottish or English rules.

    This is the company
    And the debt was incurred in England

    And when they phoned this morning they said they will be out byb12:00 noon today 9/1/15 but still no show

    The Sheriffs Office is just the name of the commercial HCEO company that feature on the BBC's [STRIKE]advert [/STRIKE]programme about them The Sheriffs are Coming

    Unless this is a criminal fine in the magistrates court they cannot force entry.

    You can (a) talk to them though an upstairs window and tell them where to go, (b) be out

    You could let them in as they are unlikely to remove anything but you will be subject to several hours of pressure to find cash. They can't take control of goods that are not yours.

    This can't be a consumer credit act debt but whatever it is it needs sorting, together with any other debts you have. So advice from CAB or National Debtline on Monday would be a good idea.

  • If you literally haven't got anything they can levy on, then the company have wasted their money issuing a writ. They cannot take any of your children's possessions, but you (they) may have to prove ownership.

    how does 5k slip your mind? Whats the debt for?
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    The debt is for rent threw a private landlord
    The past thew months iv been trying to sort my debts out and this one honestly slipped threw the net
