My aim here is that even though i have followed the guidance on here on what to do at no stage has any of this gone how it states it should and instead i am at this stage regardless of what i have said or done. I have not filed a complaint with the sra and trading standards are a waste of time as i have found out with another case. So what benefit will complaining to the sra do me at this point now that it has got as far as the small claims track!? none would be the answer.0

Do you agree to this case being referred to the small claims mediation service.
Do you agree the small claims track is the appropriate track for this case.
At which court hearing centre would you prefer the small claims hearing to be held at and why.
Are you asking for the courts permission to use the written evidence of an expert.
How many witnesses , including yourself, will give evidence on your behalf at the hearing.
Are there any days youre not available in the next 6 months.

It would give you a complaint reference number to mention in your court paperwork, and if they take it seriously enough it can hurt the solictor/NGP. If the SRA did do something, it'd reflect pretty badly on NGP. At this stage it'd probably too late for that.
Regarding the questions in the questionnaire, they are all pretty straightforward to answer.0 -

the guidance on here was to take this to popla after appealing to the PPC, you dont seem to have done that at all, even though that advice has been on here since march 2013 !
its still that advice once you get this claim off the ground
its always been the case over the last 5 to 10 years that a PPC can take you to small claims court for these pcn invoices, and since oct 2012 (3 years ago) its been the case that they can do so with the KEEPER instead, so that aspect has not changed at all either

we try to help you avoid court but its always a possibility and there were over thirty five thousand court claims in this private parking sector last year , so you are just another one
we can try to advise people like yourself, but you should have always been prepared for court, Beavis has been at this lark for 2.5 years or more and isnt done yet
my point ? court was always a possibility so we can point you at the info in the sticky threads in order to help you fight back, which we are doing, they have 6 years to do this and that has been the case since 1973 !
if you wanted to avoid court, then appeal + popla was the way at the time of the parking issue so I am unsure how you missed that opportunity ? you should have complained to the BPA about the lack of a popla code so you could take it to ADR by popla, so that still needs doing too, post #2 by fruitcake told you that, yet thats something else you have either ignored or not told us the outcome ofComplain to the BPA and DVLA that your appeal has been ignored. Info on how to do this with names and email addresses are all in the NEWBIES thread.
now its court so you need to fill in those forms and prepare for battle, same as Beavis did
I just think you are expecting a lot for free from forum members giving up their spare time helping people , you should take the advice on board and do the work, you have been picked to play in a match you didnt want to play in, so get fit and start playing or they will steamroller you
ps:- if people tell you to make complaints (BPA , DVLA , SRA and Trading Standards), you should do so in a timely fashion and manner, then report the feedback back to the forum, ignoring that advice just because you think its a waste of time isnt helping your case ! start answering questions, both on the forum and on the paperwork(you have been your own worst enemy due to not complaining)0 -
Hi all, I have a problem with new generation parking too.
I live in a building complex, and I have my car registered for my parking place. Today, when I arrived there was a car on my parking place. I ignored it because I wouldn't be too long at home, and led the car where it was, and it was only booking the car that was in my space.
When I arrived I had the beatified fine (no value) saying that I would receive the fine at home.
Should I just ignore it or call them since I parked like that because there was a car in my parking space?

When I arrived I had the beautiful fine (no value) saying that I would receive the fine at home and that they have photos.
Should I just ignore it or call them since I parked like that because there was a car in my parking space? And couldn't they see that my regards was in front of my parking space?

Because you were asked politely.
Forum rules (which are not made by regulars giving of their free time at silly o'clock to help hundreds of people each week) require a new thread for each case so advice given on the thread is specifically targeted towards the original poster and his/her problem. Otherwise advice becomes confusing, which can lead to expensive errors either for the OP or other random posters joining in with their particular problems.
Original issue:i received a pcn dated 8/10/14 for the amount of £60 for my vehicle being in a carpark in cardiff bay. Carpark was previously a pizza hut, now shut down and derelict.

There are some quite different issues between parking on a public car park and parking on own property.
Since the last post on this thread (before you reopened it) the ParkingEye -v- Barry Beavis case has travelled through the Supreme Court and as a consequence the law has changed!
