Failed UKPC appeal but worried about going to popla

Hi,

My partner is disabled and parked in a disable bay displaying her blue badge infront of her dashboard clocks as she struggles to retrieve the badge when its on the dashboard. She was given a ticket as they couldnt see the blue badge as it wasnt on the top of the dashboard but it was visible. We sent them photos that showed where the badge was and stating it was visible and there sign doesnt say it must be on the dashboard we believe the blue badge was visible and the ticket was unfairly issued.
We have received a letter saying that the ticket was correctly issued but as we are a blue badge holder they will drop it t £15 but if we go to popla for appeal it will increase to 90.
We cant afford to pay the 90 but we also believe they are taking advantage as we have done nothing wrong.
We have no experience with parking tickets but could do with some advice on how to proceed, should we pay the 15 or keep fighting. If we keep fighting what are our chances on wining through popla?

    Take a look in the sticky re popla.
    also in who's car park did this take place?
    its highly unlikely that UKPC own the car park they will be nothing more than contractors acting for and on behalf of the car park owner.
    Did you complain to the landowner/car park owner? they are responsible for the actions of their agents and if they say jump UKPC should oblige ( I know what they should say to UKPC but it would probably fall foul of the language filter)

    Don't panic. First appeals are nearly always rejected.

    Have a look at the Sticky thread for NEWBIES where you will find all the information you need on how to beat this, perticularly the How to win at POPLA section. Add an additional point in your appeal that UKPC are aware of the blue badge and therefore should cancel in accordance with the BPA code of practive AND a breach of the Equality Act 2010. A complaint to the BPA is also in order because of this, even though the blue badge scheme does not apply on private land.


    Do not pay, you have a massive chance of knocking this into a cocked hat.
