TNC new contact

Hello all

On the 8th October 2013, I wrote on here regarding a PCN I had received from UKPS (NW) and subsequent letters from them and the Ellen Court Partnership regarding payment of the PCN.

The original thread is closed now, so I can't add to it, so I have started another, sorry if this wasn't the right thing to do!!

Thanks to all the wonderful advice I received on here and a fab letter drafted by Lazy Daisy, I heard nothing for over a year. Until now. It appears another company TNC have taken up the case and I have received 2 letters from them threatening court action if I don't pay within 7 days.

My question is, do I send them the same letter again as per the last letter I sent to ECP as drafted by Lazy Daisy, or ignore these completely?

Its now over 2 years since the original parking issue occurred, November 2012, surely they can't drag it up again after all this time?

Please help me, I'm going out of my mind with worry again!

    its still DRP in disguise , ignore them

    they can pursue these invoices for up to 6 years under the SCC in england and wales, so 2 years is nothing, its only a third of the way through the statute

    read the special DEBT COLLECTOR secton of the newbies thread, tells you all you need to know

    its an LBC or an MCOL you worry about, nothing else , and it will be all over by 2019 :)

    Thank you Redx, appreciate that, I'd read most of the newbies thread, but just wasn't sure about what to do when I thought it had all gone away!!

    Hmmm .. 2019, hopefully I'll be retired and sat in the sun by then!!

    they probably have about 6 desks, one labelled DRP, another TNC, another called zenith , and another called scamsterschaseupand harassanallegeddebtor , so the paperwork just passes down the line from desk to desk, and the template letters get more "scary" with greater use of large RED fonts

    The red print is the worse part of using debt collector letters as bog paper as it may come off onto your derriere.

  • Ok, so now the TNC phone calls have started, from a Glasgow number, I have just hung up so far. I have also drafted letters to my MP, local newspaper, Police and the BPA, not sent them yet. Getting mighty cross with this now - and I've potentially got another 4 years of this????!

    If you tell them the debt is denied and that any more phone calls are harassment, and put the phone down, they should stop. Complain to the BPA about this and DO NOT say who was driving, only talk about the harassment of a keeper who cannot be liable in Scotland. You could also complain to ECP and tell them their agent is harassing you and so you hold them liable and the law changed on 1st October as far as Consumer Rights and aggressive/misleading business practices are concerned:

    Use those Regs as leverage for these complaints. A consumer can claim damages now and this applies throughout the EU because the new Regs re part of the enactment of the EU Consumer Rights Directive.
