LLoyds tsb charges reclaim

First of all I apologize for my bad english as it's not my first language.
Even though there are about 200 threads about this I would like to ask for your opinion regarding my chances in reclaiming bank charges:when i came to this country I tried to apply for an account at Lloyds tsb and I was told that I can only get the Silver account(this happened back in 2008) as I am an not an english citizen.I accepted this account as i was thinking that it was my only choice and the person at the bank didn't offered me any alternatives .Since I got the account I never used any of the account benefits( insurance,aa cover or any other). After 3 years I was having some financial problems so I asked for an planned overdraft which I was given(around £200) with the gold account(it was an increase in monthly fees) as well.After around 8 months I asked for an increase in the overdraft facility to around £1000.The bank assistant led me to believe that in order to get that overdraft facility I need to upgrade my account to Premier(£25 a month). I accepted due to the fact i needed the overdraft as i was going on holiday.Sorry about the long story but in conclusion i never used any of the benefits of the accounts as i didn't need the travel insurance or the AA breakdown cover(i don't have an licence)and I believe that i could done better with an basic account . Do you think I have a chance in reclaiming the charges? Also if I do its going to affect my credit score or my existing overdraft with the bank?I should mention I had an account with lloyds since 2008 and i never have unplanned overdraft or a bad credit score.

    If the bank required you to have the account to get the overdraft (i.e. you could not have an overdraft limit that you wanted on the basic free account) then you were not miss-sold - you could have accepted the lower OD limit and not had the charge.

    This is what it will hinge on (unless the bank just rollover if you complain and refund you) - can you prove you would have got the OD you wanted staying on the lower account?

    I don't know about non-UK citizens getting basic accounts, perhaps it was bank policy to give them some protection against someone running up debts and leaving the UK without paying for them.
