Thanks for your quick response. Is there anyway I can get them to stop calling? Anything I can say to them that will deter them?

Buy yourself a BT 8500 telephone system. Has automatic call block capability and will not allow anyone through unless you've approved them.

Gets rid of PPI recorded messages, Vindows Support scammers, hearing injury specialists and any number of ambulance chasers (as well as P4Parking and similar!!). Best 50 notes I've ever spent. Haven't had one unwelcome caller in the whole time I've had this system! A great feeling to know you've been called, but they've received the 'bum's rush' from the automaton receptionist/telephonist!

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Who exactly is calling? Is it really P4Parking, or is it a debt collector? If a DC, which one?

It is p4parking, not in the phone book so I doubt that's how they got the number.
  • Still receiving phonecalls from the debt collector. They say that they are going to "start proceedings" if I don't make a payment by a specific date. I have discovered they way that debt collectors obtain your caller information is through doing a credit check.

Does it make a difference that the fee has now been passed on the a debt collecting agency?
I know that the parking company would not go to court because of trespassing law and the fact they cannot prove/do not know who was driving the car as per advice given.
However, is there any way that the debt collection agency can actually retrieve the money from me since they themselves will have to recover there own fees?

Thanks for the advice in advance.

A debt collector cannot start proceedings against you as they are not a party to any alleged contract/debt.

The moment they recommend that their client tales legal proceedings then they are out of the loop and they earn nothing in the way of commission from anyone. So it's not in their interests for you to be sued. They just want to scare you into paying them.

Have you had the letter with SCARY RED BOLD CAPITAL LETTERS yet? :D

That's quite near the end of the cycle.

DO NOT ENGAGE THEM IN ANY WAY WHATSOEVER, ESPECIALLY NOT BY PHONE!
  • Thanks for the advice. According to another household member they have phoned before and threatened with a deadline which is long past so I imagine this will carry on for another wee while.

I have had the SCARY RED BOLD TEXT although haven't received a letter in a good few months, only phone calls. I find it strange that the debt collectors haven't written to me considering they are still working on the assumption that the phone number they have for me is correct.

I suggest that if they call again and you or your Mum or anyone else answers the phone, just say "hold on a minute, I've just got to turn the oven off" (or something equally as banal), then just go away and leave the phone. They'll soon get fed up with hanging on with nobody on the other end.

Do they ask for a named person when they call?

Might take a bit of finding, but if you search MSE for the Debitas thread there are some brilliant ideas for entertaining yourself when the DC calls. :D
