Remember, regardless of what BS the Management Company come back to you with, the lease trumps EVERYTHING.
They can only operate a parking scheme on your space by varying the lease, and that isn't going to happen (certainly not without your consent).
Remove the permit from the vehicle once you know the Management Company have received the letter and give them a day or so to act on it (i.e tell PCM to back off from your vehicle).Je Suis Cecil.0 -
Thanks again, ManxRed.
I have submitted my appeal. Let's wait and see what happen next...0 -
Appeal?
The letter noted in this thread wasn't an appeal - it was a demand.

I have just received a response back and PCM rejected me based on the following grounds:
1) I parked in a manner whereby I agreed to pay a charge, which the Parking Attendant recorded that the vehicle was parked without clearly displaying a valid permit;
2) The site is private land and is managed and operated by PCM. The PCN has been issued in accordance with this parking management scheme.
3) The use of the parking space is subject to the restrictions placed upon it by the freeholder. The freeholder has authorised the parking operator to control parking at this location. The operator's terms are advertised on signs throughout the car park.
The letter went on saying I am entitled to appeal to the IAS if I believe the decision is incorrect. However if I decide to use the IAS, the offer of a discount for early payment will be withdrawn. If I choose to do nothing, they will seek to recover the monies via their debt recovery procedures and may proceed with Court action against me.
Please can someone advise me what to do next....
Thanks very much!0 -
Can someone please give me some advice... PCM claimed that there was an agreement being made with the freeholder, where can I obtain the agreement? And obviously it doesn't appear on my lease and I have not made a direct agreement with them, are they allowed to charge me though?
Any comments would be much appreciated...0 -
Makes no difference - your lease trumps everything. If the freeholder wanted you to be subject to the terms of PCM's agreement then they would have had to vary the terms of your lease ... and that can only be done with your agreement.0

Bod1467, thanks for getting back to me.
In order to get to the bottom of it, does it mean I have to write to the freeholder to clarify and get them to contact PCM to cancel my PCN?
Really sorry.... I am a total newbie and have no idea what to do...0
