The standard advice for Scotland is always "ignore" as keeper liability (POFA) does not apply there. If the PPC doesnt know who the driver is, they have no-one to (legitimately) chase.

However, if the PPC tries court (of which there has been the odd case cropping up of late), then that obviously cannot be ignored or the defendent loses by default - it has to be defended.

    Not rocket science.....

"Not the driver" is a potentially weak defence unless you can prove it's true

Surely it's for the PPC to prove you were driving, not you to prove you weren't, unless your the IPC?

It's on a balance of probability
You need to tip the balance
A statement in court that you weren't would ( in the absence of PPC evidence ) tip the balance but if untrue would be perjury ( not recommended )
  • Let me assume then that i get several tickets at Morrisons in Aberdeen and the Parking Company takes me to court as the RK. Would i receive sensible advice on here? Er..no. Would i receive correct advice on here? Er...no. Would i receive up to date advice and help preparing a defence on here? Er...no. The regulars seem to have disappeared, replaced by dummies who joined Feb 2015. The parking companies must be laughing all the way to the bank. I'm losing confidence in the site.

Following on from the guesswork in #26 some of you north of the border who have time on your hands may want to go to Aberdeen on 4th March

    Aberdeen Sheriff Court
    Wednesday 4 March 2015
    Criminal
    #17 Civil Enforcement Ltd SCS/2015-025464 AB14012607 Court 1A

It would seem at least one PF thinks there it is worthwhile

So, despite them being allergic to courtrooms, they may have to actually turn up?
