Council car park, Straddling two car parking bays.

Hi, Bridligton Council have issued me with a fixed charge penalty notice for parking in one of their car parks. My car did in fact straddle two bays. I have photos. This is deemed to be a breach of their parking terms & Conditions.

The car park holds approximately 350 cars, and on the day in question no more than 30 cars were using the facility when I arrived, and there were fewer than 10 cars when I departed.

I arrived at 14.28 on the 5th Jan 2015 and the ticket was issued at 14.39. The parking ticket was valid until 16.43. I returned to my car at appx 16 20 and left the car park.

The fixed penalty fine is £50.00 if paid within 28 days , or £25.00 if paid within 14 days.

Should i pay up, or appeal on the grounds that the car park was empty, that the council have suffered no material loss, and finally that the Warden was unjustly over proficient by issuing the ticket within minutes of us leaving our car. or is there another possible appeal that could be applied to this case.

The incident didn't spoil the day, but I am a bit miffed that I spent 3 hours travelling, spent £90.00 in a very quiet seaside town in the middle of winter, only to swell the local authorities coffers by a further £25/50....

Any assistance would be gratefully received.

Thank you.

I'd say that you'd be best off paying it. It probably isn't worth the sleepless nights for £25.

Just put it down to experience that there are people out there who will use every excuse to get money out of you and to bear it in mind next time you use a car park like that.

Almost certainly the folks at Pepipoo will be able to help you beat this. But for the reduced charge of £25 then it's up to you whether the time involved doing this is worth less than £25.
  • Well...it was my fault , I will send an appeal letter to Bridlington Council...worth a punt, but yes, may need to pay this one...
