A typical bit of time wasting by the PPC. They know full well that the keeper's appeal timeline starts the date of the NtK and NOT the date of the alleged offence.
Just tell them that you know they are talking rubbish, so they either accept your appeal, reject your appeal and send you an IAS code, or you consider the matter closed - see you in court.0 -
Haha. Really? OK, I'll email them to that effect. Will see what happens! Do they really think that people who've appealed would be daft enough just to cough up £100 after getting a letter like that? I can't understand their reasoning for saying my appeal was too late...0

The people running (and employed by) PPCs have never usually been the sharpest knives in the cutlery drawer.

Unfortunately many of their victims are ill-informed and believe what they are told by a PPC, because they "look official". (We see it here every day ... even people we've been helping can be obstinate and need to be dragged kicking and screaming onto the correct path. How many times do we tell people to ignore debt collectors, for example?)0 -
If the large sign does not mention that leaving the site is not allowed , I do not see how even Kangeroo Chambers can refect this appeal.
I therefore suggest that you appeal and, if they do refuse, we can use their anonymous decision as a massive stick with which to beat them if ever one of their cases reaches court.rYou never know how far you can go until you go too far.0 -
So I rang them up just now, very politely, to explain that their letter refusing to consider my appeal because the appeal was dated outside the 28 day window of when the ticket was issued contradicted with the NTK which says I have 28 days to appeal from the date on the NTK.
I was told that the 28 day time period on the NTK only applies to ANPR tickets, where no ticket was issued at the time of the alleged contravention. Where the ticket was affixed t the car, the 28 day appeal window (as per the back of the ticket) is the only period in which appeals will be considered.
As per the forum, I waited until the NTK ticket arrived and then appealed.... and now they're saying I must either pay or be referred to debt recovery and incur additional costs.
What are your thoughts on this? I can upload an image of the NTK if that helps.

Do we REALLY need to repeat it?
The advice is unchanged - they are lying! If you don't believe us, go read Schedule 4 of the Protection of Freedoms Act 2012 - section 8 I think. Also look at the IPC Code of Practice - part B section 6 I think.0 -
They are wrong (if you were careful with the appeal wording) but you should never have rung them.
I hope your appeal and your phone call were both firmly in 'registered keeper mode' NOT talking about who was driving, what happened, what the signs were like on the day, nothing about the PCN and NOTHING about 'waiting for the NTK'?
If you let it slip who was driving or similar obvious sentences (even in the phone call) you missed the chance to appeal. If you waited then played it completely as 'registered keeper about the letter', then email the IPC to complain. Google their 'contact us'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

At risk of incurring the wrath of fellow forum members, and purely so I understand my situation, the following information appears on the 'knowyourparkingrights' website, which is linked to the BPA website.
You MUST follow the process as outlined in the ticket received and decide whether to accept the charge or appeal. If you decide to appeal, contact the local authority or organisation who issued the Penalty Charge or Parking Charge telling them why you think the charge should be cancelled. If they agree, that is the end of the matter. If they reject your representations or appeal, they will tell you what you can do next. You will normally be given information about an independent appeals service.
I read this as the appeal process on the ticket attached to my car.
This would seem to indicate that what they said about the initial 28 day window may be correct. I'm sorry if I'm annoying more experienced forum members, and I appreciate your responses but am simply concerned about potentially missing the option to appeal to POPLA (or even get my appeal heard by Excel).0 -

@waamo ... you're correct. New year's Eve Excel were still under the BPA banner, so any appeal rejection in respect of the event must include a POPLA code.0
