                    Hello. I got a parking ticket last week from Excel... the so and so's. Completely innocently on my part, I might add. Went into car park in Leeds, got out and looked at the big sign (attached), even saw the ticket guy there watching me... anyway, nipped into Bensons for Beds for a minute then trotted off into Leeds to do my shopping. Got back to a ticket saying I had been filmed leaving the site. Nothing on the big sign about this... but when I had another look there were smaller signs (not on the route I left the car park) about 'not leaving the site'.
So, I'm going to appeal using the template in the newbies thread, but do you think I should include my photo of the sign and say I didn't see the other one? Also, do I not include my name and address in the appeal?

PS QUite hard to read the sign but if you zoom in you can clearly see nothing about leaving the site, or indeed having to even shop at one of the shops there!

            Was this prior to Jan 1st? They jumped ship from the BPA Ltd to the IPC Ltd on 1st Jan. They need to abide by the Code of Practice of the industry body they were in at the time of the incident. If BPA then you can appeal and have the ticket dismissed. If IPC, then this lot are actually so dodgy it's not worth appealing.
 However, Excel have a duty of care to mitigate their 'loss' (bearing in mind that their actual loss is zero anyway). Presumably the warden filmed you or at least observed you leaving site.
 So why didn't he approach you and warn you of the impending loss should you leave?
 Include the fact that they have failed to mitigate their loss in your appeal. That is, if the incident was prior to 1st Jan. If it was afterwards then you're probably better ignoring the whole thing.Je Suis Cecil.0

            Thanks for the reply. It was New Year's Eve, so prior to 1st January (only just!). There's a box ticked on the PCN saying we were filmed leaving the site.
 Forgive my ineptitude, but when you say 'they have failed to mitigate their loss', what exactly do you mean by this? Should I also include the fact that there is no mention of not being able to leave the site on the whopping big notice that I studied?

            if you had read the NEWBIES sticky thread you would know you should wait for the NTK (should arrive between day 29 and day 56) , then appeal using the template letter with no mention of who the driver was or is (not dropping anyone in it)
 "mitigate their loss" means the person who watched and filmed you made no attempt to warn you that leaving the site would break terms and conditions there, but is probably only useful if this ever went to court0

            ello. I appealed my fine after I received my NTK on the 8th Feb. So my appeal was dated 9th Fe. Got a letter back today saying they aren't processing my appeal because it falls outside the 28 day window of the date of the original notice and I now have to pay £100. How does this work?!? I waited to appeal until after NTK arrived and according to them it's too late. Are they just trying it on? They mention in letter that there are signs saying don't leave the site but the massive sign I studied when I arrived clearly does not say this. Any idea what I should do next? Thanks0

 Hopefully this works so you can see bog massive sign at entrance and exit. As I said earlier, i did see smaller ones dotted around saying cant leave the site, but only after actively looking for them after getting ticket. And no, i didn't mention this in my appeal letter.0
