HSBC Claim PPI part rejected PLEASE HELP

Please could somebody help. I'm new to MoneySavingExpert. I'm retired now, but had a loan, credit card and flexiloan with HSBC for a long time. Received a letter from them telling me I had protection on them all, although I didn't realise this. I made a claim for PPI for all 3. I was told the Personal Loan PPI claim was accepted and offer has been made, but the flexiloan protection claim and credit card protection claim have been declined. The reason given for declining the flexiloan was "..premiums paid in respect of plan have appeared on your bank statements where there has been an outstanding balance, throughout the period your policy has been in force." Reason for declining the card protection was the same, even though they said they can't find original documentation.
Is this fair/right? I didn't realise that I had it and certainly didn't ask for it as I had good sickpay from my employer when I worked.
I would be very grateful for any advice/help.

    As it right? - yes, it is right in that they do appear on the statements.
    Is it fair? - depends on your complaint reasons. If you say you didnt know you had it and that was the only thing wrong you gave and they have found no other failures their end then its fair. If you have other failings then its not fair.

    Thanks for the reply. Bearing in mind that it was a long time ago, I wouldn't have taken out any sort of protection unless I had to have it. I worked for Tesco, which for all their faults, had a decent sickpay setup for employees. I'm afraid that I'm not exactly an expert on these matters. Over the years its appearance on statements wouldn't have prompted me to question it being there. I would've presumed it just to be part of the package.


    I would like to ask HSBC to send me the original paperwork for the credit card protection and flexiloan protection so that I can have a look at it but the have said they do not have it.


    Also, I would like to accept the offer for the personal loan protection, but if I do that, would it stop me pursuing the other 2 claims. And on the flip side, if I pursue the other 2 claims, could HSBC decide to withdraw the offer on the personal loan protection???

    The loan is ocmpletely separate, so you can accept the offer on that with impunity.

    Your other option if you disbelieve them about the lack of paperwork is to send a SAR and £10 to them to see what paperwork they do actually have on file.

    Having good benefits is a good reason to not have the card protection, so if they disagree with your complaint, your next step is to send it to the FOS. They can take up to 2 or more years to decide and it may not go in your favour then either. It all dpeends on whether they think enough information was provided to you at the point of sale for you make an informed decision about whether to have or not have card protection.

    Flexiloans I know nothing about so I'l leave that one for someone else :)

    Brian - 3 different complaints, loan they have agreed wrong doing over, you can accept that and still refer the others.

    Did you have any other complaint reason?
    If your argument was based on not knowing it was on your account they would defend, as they did, by pointing out it was on statements - not reading them or not questioning a charge is not relevant to them - as far as they were concerned they informed you via statement therefore you knew.

    Unless you have paperwork that proves it was not on the statement then you'll have to leave that one as you're making the accusation, it's for you to prove it, not then to prove innocence.

    With sick pay, no-one is immune to long term illness (and even the best cover - civil service - is only 6 months full / 6 months half) nor immune to redundancy but good benefits can help sway the FOS - did you provide them with details of these benefits as part of your complaint?
