My mum's tenants won't leave...

    I guess she is just a naive foreigner. I'm not sure, she never spoke of any problems when she spoke to me over the phone whilst I was abroad.



    Not that naïve a foreigner that she managed to acquire a property in the most expensive city in the UK and collect money from her tenants whilst probably failing to carry out any of her legal responsibilities as a LL.

    So she's going to get sued for £z x number of tenants = x 3. Oops

    All deposits must be protected by law. She should return them immediately

    In that case the deposits need to be returned in full before a valid S21 notice can be issued.

    Tenants may sue for up to 3 times the deposit.

    May still run into problems as multi-occupancy often requires a license from the council, without which a S21 notice would also be invalid.

    She inherited from her ex my father, strange I know.

    Quick update, my mum just told me they only paid half of the deposit.

    On the agreement the deposit section is blank :eek:. I guess that is another error on my mums part?

    It just keeps on unraveling.

    Isn't it amazing, the Estate Agent hoping to sell her flat will want a 2% commission or something. Will they do anything to help with the legal tenant removal stuff? Not likely.

    Anyway there are tons of "we'll boot 'em out for you" agencies around, some charge on success only. Try to find a reputable one, if that is not a contradiction in terms.

    Why would an estate agent contracted to sell the property have anything to do with the tenancy?


    I have no idea what you mean by a "we'll boot 'em out for you agency". I really hope you're not suggesting that the OP's mum pay someone to conduct an illegal eviction as that would be a criminal offence.
