  • On advice given to me previously on these forums (that have until now proven to be a fantastic help to me) I asked for my phone number to be removed from said energy companies database and for all correspondence to be made in writing either by letter or email.... so that I could collect a paper trail and not have to deal with some of the very forceful representatives on the phone.

I don't know if he's technically being harassed but I think that being called 5 times in one day is unfair in any case. He is not a debtor to them and so I would expect that they would not call and txt. Doesn't seem fair to me. I have tried to call them twice today to get his number removed from their call list but having been on hold for over 20 minutes I have yet to get hold of them.

Thanks to all those that have tried to help.

Why does he not just block the numbers being dialled to his phone? I do that if I get one unwelcome call.

If it is not his number then they have no right to hold it on their system or call him. He should complain about this in writing. It will help his complaint if he can give evidence the phone number is his e.g. a copy of a bill. He is not obliged to do this but the supplier may not believe him otherwise. (I suspect they can argue they have good reason to keep the number on their system until it is shown not to be yours.) If they continue to call him he may need to take legal action to stop them. The police will regard it as a civil matter. His other course of action would be to seek the help of the Information Commissioner but I am not sure how effective they are (but they do have a website giving details of how to complain).

There is no obligation on your boyfriend to help your supplier in any way.

Regarding whether the supplier can purse you for the alleged debt. Firstly if any of the amount is not in dispute then they can pursue you for that amount. However if the full amount is in dispute and the case is with the Ombudsman (having followed the correct process) then I believe they should not be pursuing you at this time. Therefore add to your Ombudsman complaint that they are pursuing for payment when the amount is in dispute. Then do not pay any of the disputed amount until you hear from the Ombudsman.

I have only just read your reply. That seems the easiest option.
