You need to clarift what they mean about why they wont pay.

A claim against them? If you say they are 100% at fault then that makes sense.. Your claiming against them.

Who repaired your car? Your insurance or theirs? Are they disputing the fact that you needed a hire car?

If you have legitimate injuries and losses then persevere. Nothing moves quickly in the insurance world (unless you owe them money)

If the TP are refusing to payout on the hire car due to a PI claim made against the third party then this sounds like nothing more than them playing hard to get.

Your solicitor should deal with this and since they've accepted liability already I suspect they'll cave in no time.

How? At the time - "Sorry all my fault" or by their insurance company.

The car took ~two months to repair and during this time we had a hire car provided by our insurance.

Two months to repair? And how much is the car hire bill? £10,000, £20,000, or more?

I can understand why the third party are playing hardball. To claim for an injury four months after the accident seems to be the problem. In my experience, you are injured at the time of the accident and it either gets better or it doesn't. At least you should have been mentioned it at the time.

The other insurance company probably thinks that you have been contacted by a no-win, no-fee pondlife company who have persuaded you that there is a few quid in it for you and more for them. If this is the case, I hope they continue to be as difficult as possible.

I guess you will need to show evidence of loss of earnings to make a claim. Whiplash, by any chance?

It's more likely the OP is claiming for the injury and possibly the car repair through an accident management who also arranged a credit hire. It's probably the car hire element of the claim that they're querying especially 60 days car hire which is probably circa £8k

2 months to repair a car ?. There might have been a few wrangles between the insurers before the go-ahead was given to repair it rather than right it off.
Also, some cars are a right pain to get spares for. So that might have been a factor as well.

Don't forget also, that some people (I can include my parents in this) don't believe in 'fluffing-out' a claim by going for PI as well as a claim for the damage caused to the vehicle. itself. And so will only start a PI claim once it becomes clear that they have suffered injuries that take more than a couple of days to heal.

Which rare car is this that took two months to repair and an insurance company were happy to allow a hire car as its temporary replacement? PI is quite different to car reinstatement and any sane insurer would want to know what the extent of any injury was, was it acute only with a well established care plan or has a chronic condition, with extent and duration been caused.

I think, that the problem is that you used the courtesy car during the time when you were off sick from work. I mean you claim , that you were in so big pain, that you were unable to work, most probably on very strong painkillers. On the other side, during those two months you were driving around courtesy car.

You are entitled by your policy for courtesy car, when yours is being fixed and you are entitled to claim for your injuries. On the other hand, third party insurance has to check if everything adds up before they pay out.

Without knowing what the injuries are in detail we simply can't determine if op would be affected when driving. She can hardly be expected to make herself homebound for the whole period. It's as illogical as saying you can't drive if your disabled.

To the poster who said they hope they drag it out, what a stupid comment. Even if op did use a shoddy no win no fee company, if the injuries and losses are genuine that that shouldn't mean you wish her massive inconveniences

It is a pointless thread anyway from a first time poster who I doubt will return.
