Just been sent a default notice, not for my bank account though

Me and a flatmate had to take out joint contents insurance when we moved out, and its in my name but the name of the direct debit on the account is in his name from his bank.

just been sent a default notice in my name because it says the direct debit has been stopped, but its not from my bank account so i'm unsure whats happened.

payments are ok until december from what i can see online, it asks for the final 3 month before 20 january.. if i set up a new direct debit before then will there be no default?

    Assuming it's a joint account and it on your credit files so you're jointly responsible?

    The default notice is for non payment. Doesn't matter whose bank account the money is paid out of.
  • He isn't named at all on the letter. Only online when it says his name for the bank details

    Without setting up another eqiufax account to check, will this mean there is a default on my account or should i be fine if i set one up by the deadline given. From what i can see payments are up to date and next payment is due on 11 january.

    Anything I can do then to remove it if its gone onto my file due to his actions, whilst he gets away with no actions against him

    That's a matter between you and him. Legally you are jointly responsible.

    Firstly delete your personal information from those pictures.

    As the insurance is in your name you are the one who is in breach of contract irrespective of where the money comes from.

    You need to speak to your flatmate to find out why the DD has been cancelled.

    You need to get a new DD set up pretty quick to avoid any ongoing problems. I doubt at this stage it has got to a default being placed with the CRAs but you do need to act quickly.
  • I'm getting a new one set up in my name now, hopefully there will be some leeway with this as i thing its hugely unfair for it to go on my credit file when as far as i can see payments havent even been missed its just for the cancellation of a DD for which i was totally unaware.

    Fact is it doesn't matter that the payments were made from someone else's bank account - you are the policy holder, the contract is between you and the insurance. If you have made an arrangement with your mate to pay for the policy, that is your private business. Your mate doesn't have any contract with the insurance company.

    The only unfair bit I can see is that your mate cancelled the DD without telling you. Those are the perils of mixing up your finances with your mates, I'm afraid.

    If I were you, I would ring the insurance now and apologise and pay the outstanding money by debit card straight away. At the same time, also set up a DD for the future payments.

    If this is the first letter regarding this matter, you probably won't see anything about it on your credit file. But ask them when you ring them to pay.

    Then I would go and ask my mate what the hell he was playing at.
