Un presented cheques

Can anyone tell me who is liable if a cheque is written and not cashed? Is there a time limit after which the debt cannot be recovered?
i wrote the cheque in October but the company only notified me 6 months after that they had not received payment. Am i still liable for the debt?

Hi Gina.
Different banks and companies have different time limits in which you can cash a cheque....some three months, some six months and some twelve months.
I would have thought that if the payee receives a cheque and for whatever reason does not cash it, then the fault lies with them. It might be worth approaching the issuer to see if they will verify and re-date the cheque, but I would imagine they will only do this at their own discretion.
Hope this helps,

I managed to get a cheque and a postal order honoured that I found in a drawer that were months out of date, so if that's you then it's worth trying. If you're the one hoping they won't take money from you, I suppose you should check with the bank.Torgwen..........
