M&S Gift receipts are they binding once given one.

My mum who turned 80 this year brought me a wash bag from M&S it came with a very small bottle of aftershave and some sort or moisturising cream. She asked for a gift receipt which they kindly gave her.

I 've gone back to the M&S store to return the item only to be told that because of the small aftershave and the moisturising cream could have been tampered with they will not take it back.

Surely if they are willing to give you a gift receipt that means that have agree a contact that the item can be returned if it's in original condition which it was. Since my mother was given the gift receipt she had no reason to believe the item could not be returned had she been made aware she would not have brought it in the first place.

Does anyone know if Im stuffed or does the fact they gave the gift receipt mean its the fault of the sales staff and therefore M&S responsibility to offer the refund.

    It depends what the M&S policy is on hygeine products like this. If the item isn't faulty, and they don't allow returns for change of mind purchases, the fact you have a gift receipt doesn't matter.

    Gift receipts don't give you additional rights, as you seem to believe, they simply transfer the standard legal rights from the original purchaser to the receiver.

    You could always use it as a present for someone else's birthday/Christmas if you don't want to use it!

    Edit: It seems you are out of luck. The M&S site says:
    The following items are excluded from our "goodwill" returns policy:

    Gift cards, beauty*, food, food gifts, Food to Order, earrings, wine, <snip>

    I would imagine your item comes under the 'beauty' range.

    Receipts aren't just used to return items that people don't want.

    There could be a problem with the gift that means it needs to be returned, in which case they will use the issued gift receipt.

    Take it back again and ask to speak to the manager, they have far more powers than the customer services staff. They don't usually accept the return of toiletries but it may be worth a try.

    if the washbag was faulty they you could use the gift receipt to return it as faulty, but just returning as you dont want it or like it then their policy of not allowing returns would come into force

    1/ I have never heard of a "Gift" receipt (just you and your Mum I guess) - I've only heard of "a receipt" (evidence of purchase)

    2/ Even if there was such a beast it would not negate their T & C

    3/ Its obvious that anyone can appreciate why aftershaves, creams, drugs, medicines (could be opened/used/infected) can not be resold
    When will the "Edit" and "Quote" button get fixed on the mobile web interface?

    Toiletries could be contaminated once sold so would not be possible to resell and the company would have a policy to reflect this
