I agree but POPLA don't. I helped a person try that in a POPLA appeal and then a complaint to the POPLA Service manager Richard Reeve, and he said he had referred the complaint to the Lead Adjudicator. They dismissed the idea that the operator should have mitigated the loss (unusually, the POPLA appeal was lost because it was from Napxxx who roll out an invoice from Counsel for £2000 to balance their GPEOL - and POPLA sometimes swallow it).

So POPLA said in answer to the appeal point in bold which the person had gone into great detail about, spelling out the reasonable steps the operator could have taken rather than sitting on their hands and allowing PCNs to accumulate:

The operator has failed to mitigate their loss.
''What was being considered was a genuine pre-estimate of loss, not actual loss suffered.''
