Refunds from Cash Converters

Good evening I need some advice regarding getting refunds/replacements from Cash Converters.
My oh bought me a phone for Christmas. He bought it on the 1st of December, then hid it in his clothes drawer until Christmas Day. Less than week after unwrapping it it has developed a major fault with the screen. I have rang around mobile repair shops and the cheapest quote I got was £119 which seems an awful lot when we only paid £100 for the phone less than a month ago.
My oh dug the receipt out and it says the phone only had a seven day warranty, which naturally ran out ages ago. So what I want to know is, how do I proceed? Do I go back to the store, or straight to the head office? I am technically out of warranty going by the date on the receipt but it has spent 24 days wrapped up in a box unused and has only been used for 6 days. Any help greatly appreciated. TIA

The Sale of Goods Act does apply to second hand goods. These goods will not be expected to last as long as a brand new phone, but for £100 I would certainly expect them to last longer than a month. If the fault is inherent (as opposed to fair wear and tear or misuse by you and not the previous owner) then cash converters need to offer a remedy.
Have you spoken to them yet to see what they say?0
