Citylink- Some advice Please

Right so here is my situation

I currently have 3 parcels which I will not be able to get which are located at Citylink Gatwick - they were meant to be delivered on 23rd December and they did not show up

I could not collect yesterday as I was away for Xmas period and even if I was home it was over an hour each way for me to get to so would not have been able to as wife would have had the car

Now two are comp wins, one is of value £300 and the other £50, I heard on the news that all parcels will be destroyed by Citylink now - what a waste!- so where do I stand? Have I a right to go back to the comp organisers and say ( I did email them to say about Citylink in administration and are they being returned to sender but had no reply ) and ask for a replacement or have I got to write them off?

The other is an Amazon purchase so will be contacting them to see where I stand on it

Horrible situation all around and there must be thousands of parcels from people unable to get to a hub ( when they are not all local ) within a set 24 hour period over the Xmas holidays

  • On the Amazon one, use the consumer contracts regulations (old distance selling regulations)
    To cancel the contract with them.
    They used the courier, their responsibility is to deliver the goods to you.
    I do not buy this advice you have to trail out with your own fuel, time and money to collect something that has not been delivered.
    The responsibility is the senders to get any purchased goods delivered to you.
    Until they do you have cancellation rights.

    The billions they make in profit, they can afford to have all their stock collected and re sent via a new courier.

    In short in my opinion it is not "your" parcel until it gets delivered and signed for.
    I do Contracts, all day every day.
  • I thought they were asking senders to collect, or you can if you have a missed delivery card

    I would say it was up to the sender to collect their items - usually any goods you buy or win are the responsibility of the sender until they reach your home. I would chase the sender/company you won your prize with.

    In both cases the liability lies with the sender and is to coin a phrase 'not your problem'

    If you do not receive your prize pursue it in the usual manner.

    Having said that I can well imagine small traders going out of business as a result of this.

    There's something to be said for nationalised mail delivery... oh dear.

    I am surprised if parcels can be destroyed.

    From what I found via Google, they are saying that parcels might have to be returned, and they would not "rule out" destroying some. I read this as meaning destroying them is a last resort, and my instinct says most will find their way to the recipient, or back to the sender. I don't really see how they can legally destroy other people's property - at least not without trying everything possible to return them first. GL. Blu X

    I'm 5 min drive from them in Gatwick,They are right next to my sons workplace,I know that's no use but If I could I would have picked them up and sent them on to you x

    [STRIKE]You could maybe find a local courier and ask them to pick it up for you, you'll need to pay for it but If you're worried about not recevining the items at all then it might be worth just paying the outlay.
    (You'll find a local one in a yellow pages type listing, I don't mean someone like Parcel Force, someone like "Jim and son couriers", who will go get it for you).[/STRIKE]

    i would contact both suppliers and say its their responsibiltiy to get another item out to you-how is it fair to go traipsing round trying to recover parcels-u didnt ask them to use citylink
