    By definition, the landlord cannot already know anything that comes up.

    That's irrelevant in any case, there's nothing wrong with a non-refundable application fee, they are used in many situations.

    Ok the LL is informed, seeking confirmation.

    There is something fundamentally wrong with non refundable fees, if those fees are used as any form of income to the LL/Agent.

    Fees rarely match up to the actual 'cost'. It does not cost £150 to reference a tenant.

    If the prospective tenant pays for a service (for example a credit check, employment check and so forth) and pays over the 'cost' price, there is a fundamental conflict of interests. The Agency is making money for nothing, with no obligation.

    A good system is where in theory the application is suitable, and therefore the fees will normally only be returned if the LL changes his mind. If the checks reveal new information, which was not previously known, then ofcourse the fees should not be returned.

    That may well be blunt, but it's not very fair is it.

    If a prospective tenant advises of any past financial issues and the LL proceeds with the check, and that check confirms what the applicant has said, it's not right they should lose the 'fee' (read landlord profit bonus payment).
