Abandoned car on private land

  • It's a tricky situation which is why I would advocate moving it just enough to access your land. I can't see what offence you would be committing as long as you do not damage the vehicle. You would not be driving the vehicle, so it would be the registered keepers responsibility to MOT, insure and tax it.

I had a similar situation where somebody used to park in my driveway. In the end, I decided prevention was better than cure and stopped access to it by fitting a parking post.
  • Where councils take no notice at all of an abandoned vehicle, is there please one of those template letters that are done that we can print off and send to councils that remind them that they do have a duty to get involved with such cars?
But this particular vehicle has not been abandoned, so the council have no duty to get involved.

I still don't understand why you (or the Management Committee for your properties) don't raise a civil case against the registered keeper of the vehicle. Or do you expect the taxpayer to foot the bill for you?

OP it would be good if you could find this legislation that you are talking about. Is it S99 Road Traffic Regulation Act 1984 as ammended in 2012?

If this is the legislation that's fine, but we need to see the regulations, I looked for them but did not find them. The regulations will say who the empowered authority is (hopefully) it would also hopefully say under what circumstance the council has to act, it may be the council does not have to act.

You should understand that we are not lawyers here, some of us have an interest in law (like me) and I like to quote the laws that we are talking about into the thread and try to spark debate amongst our other users who like law, but, as in this case, usually no-one debates the laws with me, which is frustrating and unfortunate but there's nothing we can do about that.

The rest of the users here who have no knowledge or interest in the laws will just be the ones who post synical and silly remarks.

Oh, have you checked it is insured? You can check on askmid. It needs to be insured to be in a public space, so you could report it to police for not being insured in a public space....

Don't worry there are no internet police who will check to see if you have ticked the confirmation box unlawfully. :)

My blue badge was provided as I see it to make things easier for me. If this helps my visitors and means that they don't have to pay to park on the road, where I can park for free, then this helps make things easier for me.

How is it helping and making things easier for you, you should be reported for abuse of the badge, try reading the DOT booklet that comes with the badge specifically page 8.
The badge is for your use and benefit only.
You must never give the badge to friends or family to allow them to park for free, even if they are visiting you.
It is a criminal offence to misuse the badge.
It is disabled people especially with that user name and with your attitude to the use of a blue badge that give the rest of us badge holders a bad name and reputation.
  • I don't see how it is unfair that I use my badge. Disability is a protected characteristic and all I am doing is showing that. I have a right to.

You have a right to use the badge for your own personal use not for other peoples use, going by this thread and some of your other posts you appear to think it gives you permission to use it to flaunt your disability and it gives you some rights to produce it as an excuse to do what you want whether it is permissible or not.

As already said read the booklet before spouting off about Disabled Rights For Me, as far as I am concerned my blue badge is a concession not a right and it can be revoked for misuse and abuse.
  • Honestly, why didn't you torched it up long ago? Fire crew will call police and police will have to get rid of it as it becomes a hazard, isn't it?
