Car park partnership fine

Hello,
Apologies in advance if I break any of the forum etiquettes, I haven't used one for years.
I recently got a ticket while parking at nottingham university. I was attending a Councelling appointment at the main campus. When I arrived the gate person directed me to the visitors. I parked up and went to the ticket machine which was out of order. I walked around looking for another machine or a car park attendant, of which there were none.
I was getting late for my meeting, so having wasted 15 mins I left a note in my window say machine was out of order and I stated the time of entry.
When I came back I had a ticket.
So I immediately appealed. But that was rejected. Since 18th Dec ive been trying to get a POPLA code but no luck. CPP don't answer their calls and the address on their website,mail just gets returned.
Has anyone else had this with CPP? How do I get a POPLA code etc?

3) Complain to BPA about them not giving you a POPLA code - that's sanctionable.0 -
When you say sanctionable do you mean I can hold that against them and they will probably lose if I did end up in court?0

Hello, I've looked at all the threads and stickies, and I just need some advice on what to do if I don't have a POPLA code. I just have a response from Car park partnership letter which I can show if need be, say they will hold the charge for 14 days while I provide further evidence. I know this is just nonsense as they didn't look into my original appeal properly (as expected).
Should just complain to the BPA (which I have already done)? Any other options?
I'm tempted to just say lets go to court and see what happens?0 -
nothing you can do if you have complained to the BPA, other than complain to the landowner and demand a cancellation
the sanction if applied is by the trade body (the BPA) so is merely a rap on the knuckles due to them not abiding by the BPA CoP , which could form part of any court defence but other more important legal aruments would hold sway in court anyway
if the landowner or managing agent decide to take you to court, that is up to them , and this can take up to 6 years under the small claims
your best bet is wait and see what happens from the BPA, who may get you a popla code , but complain to the landowner whilst waiting for your complaint to be dealt with0 -

Hello, thanks for all the advice, very much appreciated.
I did eventually get my POPLA code on the 30th of Dec. However CPP are offering me an additional 14 days to provide further evidence or pay the reduced 'invoice'.
The evidence I have is a photo of the out of order pay and display machine, which is why I didn't buy an ticket (and there wasn't an alternative machine).
What do you think I should do? I already sent CPP the photo of the machine but they just said they need more evidence (not sure what though).
Should I just go for the POPLA option and get some help on the forum to check my appeal letter?
Any advice on how I can approach the POPLA appeal, as I believe there is a breech of contract for not having an alternative method of paying for the ticket? Or should I go for the more generic appeal of there not being a contract and inadequate signs etc?0 -

I'm drafting my POPLA appeal, but I think I may have screwed up by not reading this thread before I did my initial online appeal. I kept referred to myself i.e. I did this, and I did that. But what I should have done is referred to myself in the 3rd person. Is this going to badly compromise my POPLA appeal?
Here's my original appeal to the PPC, which I did on their webpage as soon as I got home:
"I decided to park in the main visitor car park at the University of Nottingham as I had an appointment at a building near by. I drove into the car park and parked in a bay that was free. There were no signs to say I should only park in a particular space, and it was not clear whether a particular space was for staff or visitors. I am a trainee doctor so technically I am a staff member as well. The ticket says "in restricted area", but the space itself didn't say anything. I parked and then went to get my ticket from the machine, which was out of order (picture attached). So I walked around the car park for 10 mins to see if there was another machine. There was no other machine available to get a pay and display ticket, and nor was there a sign on the machine that was out of order to say where to go in such an event. I had an urgent appointment which I was getting late for, so I having spent over 10 mins trying to find a way to pay, I decided the best thing to do was leave a message in my windscreen saying I'm happy to pay, but the machine was out of order. I put my name and course, and also the time I started my parking (picture attached of message in windscreen). Some other cars had done this also, so I thought this was the best course of action. There was also no parking attendant or anybody else there to ask, and there were no signs to guide me on what else I should do.
I went to my appointment and when I got back there was a ticket in my windscreen.
I am appealing because it is grossly unfair to penalise me having made every effort to pay and display. There was no sign on the out of order machine and nor was there any sign to tell me that the bay I parked in was restricted in any way. Upon entering the car park there was no sign to say the machine is out of order so don't park here or what the alternatives were to pay. I am happy to pay for parking as I normally do so everyday at the medical school car park which is on the other side of campus, but I happened to have an appointment on the main campus so this was the closest car park I could have parked in."0
