Defaults/Mortgages what can I do?

Hi,

Just wanting some advice in default notices. I have 10 on my account but I'm now just about out of debt.

I started a debt management plan in July 2010. The defaults on my accounts were applied at various times ranging from July 2010 - March 2012. Some of these companies were late and others sold the debt on when they weren't happy with the minimum payment. Can I ask for these defaults to be changed to when I went on the debt management plan as I thought they were meant to register the default then? How would I go about doing this? Do I need to contact the company who registered the default or the original debtor?

Will they automatically drop off my account over the next year or two or do I need to do something to remove them?

That will take care of 7 of my defaults. I then have one with Orange which got passed on to a debt collectors and I have now paid but won't drop off until feb 2017. This was a very old phone contract with £80 left on it. I tried to pay it off in full in 2010 but orange couldn't find my account details even though was on my credit score as unpaid so they said just to leave it. Step change tried to add to my DMP but had the same problem as I didn't know my account number. It turned up years later with a debt management agency and I paid it off in full. Do you think I could get the default date changed to when I went in my DMP?

The remaining two I don't think I can do much about as they are reformism a mail order company a month before I took out my DMP but stupidly didn't put them on and defaulted 3 years later :( is it possible to get a mortgage with 2 defaults on my account or will I need to wait until they are all clear?

  • Aim is to get a mortgage ASAP and figure I need to clear some defaults to do that. Plus it seems unfair they are currently incorrect on my history.

    The accounts and defaults will drop off automatically 6 years from the default date. You don't need to do anything. The Credit Reference Agency systems drop them automatically.

    You can certainly argue that the 2012 default for a debt they said was outstanding in 2010 but would not let you pay is incorrect. At latest that should probably have been recorded as 2010 or within 6 months of when it became due but was not paid.

    The DMP won't aid your mortgage application. If you've got money available you'd be better off clearing your debts as soon as possible. Nor will lenders you've previously defaulted on necessarily be that forgiving.

    Everything will be paid off by the end of Jan. Just starting to look ahead to the future now.

    Thanks fermi do you know how I go about contesting the dates? Do I need to write to the companies involved? Not sure what to do where the debt was passed on too?

    You write to whatever company it is recorded against on your credit file. They are the data controller responsible for the accuracy of the info recorded.

    Absolutely right - if the debt has been sold on don't let the new owner fob you off saying it is the original creditor's responsibility
  • Low and behold they've come back and said the default was applied when the account was sold on my the original company! Is there a law/act I can quote when going back to say it's there responsibility to make sure the data is accurate and up to date? Usually find if Ive done similar things in the past you get somewhere a bit quicker!

    Complain to both as they share responsibility for accuracy. Then take them to the FOS and ICO if they dont correct it.
