buyer has ZERO to lose (legally) and is entitled to full refund (totally made whole) if the seller does not perform their part of the contract

I think we'd already worked that one out.
And no, it really isn't that simple, which you might know, if you'd ever been up in front of a judge (especially for a civil matter).
That is why we have courts and judges, to interpret and deal with the law. If it really was that open and shut for everything, we wouldn't need them.0 -
I phoned RM this morning, spoke to a very helpful CS - he emailed me a copy of the signature and printed name, and he is getting in touch with the local depot, there will be an answer from them within 48 hours.0

Buyers obligation stops at providing the correct delivery address for obvious reasons
divorcees would also benefit if they could simply "work together" and save £1000s in solicitors fees but when it comes down to who is right, and who is wrong that does not negate the seller being 1000000000000000% responsible for delivery of item (meeting their end of the contract)

So you are saying that as Seller can prove item was delivered by producing tracking to the address that paypal supplied it is hard luck buyer?

Yes I will do all I can to assist the buyer, it is being investigated now, apparently the depot will ask the postman who does the rounds for that particular house whether he remembers anything.
I have a copy of the signature and printed name. Either someone has been rather forgetful or there is some serious fraud going on!0 -
We had an issue last week at work, where some items didn't turn up.
On contacting the courier they said they were signed for and described the signature, which included our person's name and a flourish, which was not her signature at all.
She got back to the courier and told them that, made it plain that it had not been delivered to our address, and asked for more details.
They suddenly found the item in a van after all and delivered it poste-haste!
This is a real instance of a courier faking a delivery and signature - it happens.0 -

Given its xmas and boxing day. I would think you will struggle to get a reply before next week.
The system those enquires are logged on has an expectation of a 48 hour reply.
There is only one working day left this week for RM.0
