Who pays the EA fees with part exchange?

We are part exchanging our house with persimmon and the EA said we won't have to pay their fees.

We exchanged contracts today and are completing tomorrow but need to confirm our completion statement as the amount seems to be £1800 too much which is what the EA fees would have been.

Who pays the EA fees after completion with part exchange?

    The builder, usually. That's what happened with us (completed a fortnight ago).

    The solicitor might have made a mistake in calculating, assuming fees were due. They make mistakes.

    It's unclear what your situation is. Do you mean the estate agents the builders have elected to resell your home, or was your property on the market prior to deciding to PX it?

    If the latter, you may still be liable for estate agent fees - check the contract you signed.

    Our property was on the market with the EA and it's the same EA that persimmon are using to re-sell our property

    I will query it tomorrow with the solicitor. We have agreed to complete tomorrow so I am hoping the issue with the EA fees will not affect the completion

    If that's what the EA said, then that's almost certainly a contractual agreement, which you relied on.

    A problem arises if the EA deny they said it (unless it is confirmed somewhere in writing).

    It then becomes an issue of your word against theirs. If there's a dispute over this, make your solicitor aware.

    (In the extreme situation, that you can't resolve this, and neither side will back down, I guess it could end up in court. Essentially, the court would consider the evidence and decide who is probably telling the truth.)
  • The solicitor had not included EA fees so it was a miss calculation on my behalf.
    Yes completing today as persimmon have agreed we can stay in our house until 5th Jan so we have plenty of time to move
    How long does completion take? Will the funds get there instantly? If so do they release the keys straight away?

    Congratulations! Sounds like best of both worlds completing but staying put over Christmas :)

    You'll get a call from your solicitor when it's done.
