Payment of a bill

Hope someone can help.

On 12 Oct 14 I purched £3853.00 worth of furniture (sofa, dining table, chairs, sideboard, lamp) from home and furniture company, it's a friend of a friend shop that had just opened so as a favour I greed to have a look as I needed furniture for my new house, and they would give me discount, on that date I also paid a £2000 deposit. Then on 21 Nov 14 I purchased a Divan bed at £299, and paid my bill off in full which was £990.05, and was informed I had been given discount and that was everything done. On 19 Dec 14 I receved my sofa which is faulty and was given another bill in my home for £539.15 and was told they had given me to much discount, is this right a few week down the line when the final bill had been settled they can give me another, I fell they have done this because my friend works there, if I was another customer they would not have done this and in there own home as well, what's my rights, do I have to pay.

    What was the total agreed price for you to pay? £3853 or some other amount?

    They cant keep you to your obligations if they aren't going to keep to theirs. But if you agreed £3853 as the price to pay and there is still £539 outstanding then it would still be owed - they've simply made a mistake when taking your earlier payment but the actual terms (of you paying £3853 in return for xyz) were already agreed prior to this.

    If you've agreed one price and they're now trying to up it...you would likely have recourse to hold them to the original agreement as its not an obvious mistake (imo) and a contract has been formed. However if it was going to cause too many issues (with friends being involved), I'd likely just cancel and order elsewhere rather than trying to get them to honour it.

  • When I went to pay my final bill I was told to pay £990.05, to me that was it, until three weeks later when they delivered the sofa with another bill saying they made a mistake and gave me double discount, surly that's not my fault?

    But before that, when you ordered the furniture, what was the final price that was agreed?

  • There was no agreement, It was on the receipt saying the total was£3835.

    So that was the price you were originally going to pay? I didnt mean an agreement in the strictest sense....I mean the price you agreed to pay in exchange for the items.

    Why else would you leave a deposit unless the price and items had been agreed?

    And how much have you paid? If you've paid £3835, then you're fully paid up and they can't just remove the discount after the fact. If you've paid £3295.85, then they're in the right and you still need to settle your bill.
