Parking eye - should I phone them?

Hi.
I need some help please if you can.
I have a letter before court claim for over staying a 2 hour stay by 40 minutes, in a free car park. I have not appealed as I thought it was sorted out for me by the store I was parked outside.
I have read the sticky thread but as I have a brain injury I can't take it all in and come to the correct route I should be taking.
The car is insured for 3 people to drive it and the registered keeper is disabled and has a blue badge, although the badge was not used in this instance as the car was parked in a normal parking space.
One of the insured drivers works for the store it was parked outside but was unaware that you had to register your car with Parking eye if you park there for work as they had only recently started work there and was not told this as they usually have a company van.
All the parking eye letters have been given to the store who have now registered the car with them, and said it was sorted out, but obviously it isn't as I have now had the letter before court.
So what I would like to know is should I phone parking eye and explain that the person works in the store or will it make no difference to them now, most of the advice seems to be not to phone them, but not sure if these would be different circumstances.
I am sure I have read that there is someone either on here or the pepipoo forum that you can pay to help you sort this out for you, could someone give me their details as I'm not very good at taking in information.

Firstly - DO NOT PHONE PARKING EYE. It would serve no purpose as their only interest is to relieve you of your money, and any reasonable explanation you might have is of no interest to them whatsoever. In fact it is possible that you could complicate the situation by unwittingly revealing more information about the circumstances surrounding the ticket. So don't do it!

Write naming the actual driver and obtain a certificate of postage.I do Contracts, all day every day.0

you should be getting the LANDOWNER to sort this out and to get that charge (INVOICE) cancelled forthwith
whatever else you do (and no I wouldnt bother phoning them at all) , ensure that you put the onus on said landowner to rein in his hellhounds asap
only the landowner can legally take you to court, so get that landowner onside and dealing with it0 -
Thanks all. I should have mentioned that I am the registered keeper but was not the driver at the time but they do live with me. They have taken all the letters to the store they were parked outside and the store has said that they have sorted it but the letters are still coming, the driver doesn't really want to cause too much hassle in the store as they have only just started working there.0

I would be as sly as they are.
say you have spoken to the driver who will pay the "fine" if they send it to the driver.
Then when the driver gets the new PCN, appeal and POPLA them.
You dont really want this going to court as the Judges are very "starstuck" with this parking firm for some rather odd reason.I do Contracts, all day every day.0 -
this should have been appealed from the very first pcn by the RK
but as RK you can name the driver and give a suitable service address for the paperwork (ideally not the same as your own, so a relatives ? )
the driver gets a pcn in their own name, appeals it using the template letter in the NEWBIES sticky thread, then appeals to popla if its not cancelled
this gets you off the hook as RK
but the landowner/store should still be insisting on a cancellation - regardless - on your behalf or on the drivers behalf0 -

Naming the driver is a formal part of the procedure defined within PoFA 2012, but you need to do that pronto as this is only available to the RK until such time as formal proceedings commence.
The LBA/LBCCC is not the start of formal proceedings - but you're not far off them!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Agreed - obviously reset the clock to 'PCN appeal stage' by the keeper telling PE the name & address of the driver. This is so easy to rewind then win. Resetting the clock to appeal stage ('FORUM SPEAK' - NOT A PHRASE TO USE TO PE!!) is explained in the Newbies thread, with a link to the short letter/online challenge for the keeper to send which gives the driver's details.

Hi,
Just an update on this.
Today I received a letter from Parking Eye to say the charge has been cancelled and there is nothing to pay.
So thank you all for your help in resolving this.
I was a bit worried as when I sent the address of the driver to them I put the new address but with my postcode by mistake, not sure if they noticed but thankfully it's all sorted now.0
