    Yes.
    what can he do about it in the real world of Tory Britain 2014.
    Nothing except lose his job.
    They can sack him for no reason and any tribunal now has to be paid for by the employee which is rather hard with no job.

    If he wants to keep his job, put it down to experience, keep quiet, keep his head down and hope it blows over.

    Is this "right" of course not, but it is how things are in the real world.

    Its a two horse race these days, Job or no job.


    Not being even remotely Tory - is it worth the rant when Labour have made it clear that Labour Britain will be more of the same? Politics isn't even a two horse race any more...

    It *was* just a misunderstanding :). Not sure who said what to him, but it's been confirmed that he is being paid for all the hours he worked on Friday, plus the hour he went home early. And the extra hour he worked on the Saturday, is being paid as overtime.

    Actually - what a lovely firm to work for. He needs to hang in there, I think :)

    No - it doesn't depend on the contract. What is counted as sickness absence under sickness absence policies is determined by the company. The pay you are entitled to is determined by the law.


    And being HR compliant wouldn't fill me with confidence. There are some great HR professionals, but as a general rule the only collective that get the law wrong as often as HR are ACAS phone operators.

    agreed, but im saying my company would likely count the part day off as a sickness under BF (depending on how on the ball the manager is) but likely would not 'dock' the pay (ie revert to SSP, or whatever is in the contract, which will either be the minimum the law requires, or more) for a 'part sick day'

    A full sick day, on the other hand...
  • My understanding is that you cannot pay SSP if someone comes to work even if just for a few minutes, as it does not count as a days sickness for SSP purposes. I always paid for the whole day if someone came in. Less trouble and fairer all round.

    What does his contract say? Is it a set wage or an hourly wage?
    What does it say in relation to sick pay?
    If its a small company, I agree its probably not worth making waves someone with little experience leaving a job after 5 months will not look good (if the employer tries to push him out). If a large firm then I think I would go back to my manager discuss it and try to understand how you can lose a full days pay for an hour or even if he went home after 2 hours how he can still lose a full days pay.
