Credit Hire Car Insurance

I got a letter today from Enterprise car hire. As part of my non fault car insurance claim I was entitled to a Credit Hire car for the duration my car was out of action being repaired.

I didn't realise the difference between a courtesy car and credit hire. Anyway the letter say they need my help to pursue the third party for the hire charges are they are not paying even though they admitted fault and paid for the car repairs - everything was done through LV insurance. I just made the initial claim and gave details.

They say they are not asking me to pay nor will they but they still want me to complete and return an "Authority to issue" and a pre litigation questionnaire. It says "enterprise car hire will meet all the costs"...

Has anyone had this situation come up? If so can you give me any more info?

I was about to complete and send then thought of asking here first just in case. Thanks.

    Credit Hire charges for car hire is considerably higher than normal car hire.

    Your Insurer was paid a commission of circa £300 by Enterprise for passing you over.

    Enterprise are obliged to make it clear to you that the car is a hire car under a credit agreement.

    Due to the increased costs of a credit hire, Insurers often query the costs involved and court action if threatened by the hire company. The Insurers tend to come to an agreement with the hire company prior to court action.

    You will have signed a contract agreeing to assist Enterprise should it go to court.

    You will typically need to give a statement and they will often request to see bank statements. The bank statements are because if you could have afforded to finance the cost of a normally priced hire car then Enterprise may not be able to recover the full cost of their car hire.

    Why do they all play these games between themselves ...

    I thought i was entitled to a courtesy car (thats how the policy was sold to me) and so i didn't take much notice as to exactly what i was signing. I did notice they "up spec'd" the car i was given but i didn't think anything of it.

    So basically, its just financial + legal tennis between the companies? I don't have any liability except to assist as necessary? Thats how it seems. The letter says if they are unsuccessful "we will not look to recover any of the hire costs from you".

    Ill send it back today.

    It was a contract, where you agreed the ts + cs!


    Read up on your responsibilities when you sign anything.



    (A "courtesy car" is quite a different animal to an enterprise hire car - read up on that too)
