you cannot receive a CCJ if you paid the court judgement (if it went that far)

let a judge decide, if it ever gets to one , pay up if you lose , still no CCJ

learn the facts, dont ruminate on innuendo and falsehoods

as mentioned above, get the landowner on your side and VCS will struggle , get something in writing, check the lease etc , create a paper trail

Well i did the appeal to IAS and it got turned down. I haven't paid the charge, however yesterday i received a letter from VCS saying they they were disappointed that i hadn't paid the charge. they have given me until the 23/03 to pay or they state that they may commence debt recovery or legal proceedings. any court costs will incur costs and interest. They also make great point that a CCJ would affect my credit rating.

We received the exact same letter yesterday with the exact same date (23/03) - VCS must have had a batch print the day before ;)
  • Thanks everyone, I really appreciate all the replies. I'm going to tough it out i think. My Daughter got in touch with the landlord but no response really, he doesn't seem bothered. I do have a parking ticket for the car park for the day in question, my daughter had this but we never got this on the vehicle, so when VCS saw my car it was parked without a ticket, she got this upfront without me knowing, it is signed and dated. I sent a photocopy of the ticket with my appeal. The way i see it there is no loss. The landlord has had his money for parking. I'm just guilty of not displaying the ticket. The appeal result was an email and was i thought quite a poor response. Thanks again for the advice.

That's the big question. As you say, the landlord has received the money from the P&D ticket, so why are VCS pursuing you? Even if a P&D ticket had not been bought would VCS pass on that "lost" money to the landlord if you pay their fake fine? I doubt it.

Not sure what my next step is!!
The wife thinks i should consider paying, this will hurt as i feel i have been mugged, but it's an option. I would appreciate any advice. I do not want to go to court over this and spoil my good name that is my big worry, also i do not want the costs to start spiralling out of control. really not sure of the nest step.

But in the post above your rejection letter one I had told you this would happen and not to bother with IAS and not to worry if you lost or ignored them - it was all explained. Told you to ignore it and the unlikely possibility of a small claim - which doesn't affect your credit rating if you defend, lose then pay it straight away.

I explained all the steps and you took another - but are still thinking you have to pay? Please read it again, my post above. This is frustrating and madness that you wife thinks you should pay - did you both not read the advice given? It's not that difficult, no idea why you tried IAS - you were bound to lose. Start ignoring them unless they try a small claim; people have done this (ignored this trash) for a decade and the sky does not fall in.

    Hello Everyone

Thought i would update you all, it's been about 2 months since the demand to pay up arrived, any way as you all advised i ignored it. I have just had a letter from a company called DRP Debt recovery plus ltd. they are now demanding i pay £160. they say if i don't pay by 25/05/15 they will recommend that court action is taken against me. the letter gives lots of options to pay. it doesn't look quite right, seems it seems like a different angle of trying to get me to pay. I'm going to ignore it i think and wait for the court date. What do you all think?

  • Hi everyone

It's been quiet for a about 12 months, now i have just received a letter from BW Legal, same old demands they want £100 + £54 costs and have given me 16 days to pay. they say in this letter if i don't pay they "will seek our clients instructions to commence legal proceedings" they say because i failed to pay and made no appeal within 28 days the balance is due. the thing is i did make an appeal but it was turned down. Not sure of next step! i was going to wait and see what happens next. i have always had the view that i would go to court if required as i do have a parking ticket for the day i parked it just wasn't in the car. Any advice would be appreciated.

You need to search the forum for BW Legal to see the court cases they have begun (sorry but they have, especially v ignorers) and how to robustly respond to this letter. Do not 'wait and see' - stop being low hanging fruit - you need to look reasonable and respond based on what you will read on all the other dozens of threads exactly the same.

Some are at court stage, some are at your stage so get searching for those words and read the results. Or even just search '£54 Excel' or '£54 VCS' or '£54 BW Legal'.

I realise yours was VCS (not as litigious but the sister firm to Excel) but the letter you have is the same. Needs a response and you will find an example by hoohoo if you search as I suggested.

Makes no odds that you lost an IAS appeal by the way, that was a given. Not what a court would decide, necessarily - and VCS are not litigious like Excel are - so you may be able to head this off with a robust exchange of letters.
