Car vs Cyclist Insurance Claim & legal advice.

Hi,

I was recently knocked off my pedal cycle by a driver on the wrong side of the road. I was walking wounded, with damage to my gear and bicycle.

At the time the driver admitted liability and has since reported to her insurance company. This was two weeks ago. Though I have requested it, I have not received an insurance claims form or been updated with any progress.

I have sent them an Email, to which they have ignored. Please advice of anything I can do or supply a template of a letter I can send to the insurance company. :(

    Have the insurance company given you a reference number.


    Have you written a statement of what happen, a sketch of the scene, any photos of the scene, damage etc. quotes of repair/replace your gear/bike. If you had to take time off work did you get a sick note/medical note.


    Don't email insurance company, write and send copies of your statement etc. but since its the Christmas period might want to wait until January.


    You might be able to get some legal advice via your home insurance.

    If you are awaiting a claim form from the third party insurer then you may have a long wait!


    If that is the case, then you may want to consider getting your own personal injury solicitor to pursue your claim for you
  • Thanks for your replies. I have made a full statement. Sent an itemised list of damage injury caused. Reported the RTC to the police and have a log number and the insurance reverence number. I also took details of an independent witness. Like I said earlier I am after a template so I can send to the insurance company making my claim. Cheers :beer:

    If you just want to claim for damage to your property just send them a letter, refer to the incident, tell them you hold their insured responsible and ask them to reimburse your costs.


    Append your list of the damage caused together with quotes for repair/replacement.


    But if you have personal injuries too, then do consider instructing a solicitor to represent you.
  • I don't think there is a standardised claim template, a quick browse online it seems different insurance companies set there own. You could possible see if the insurance company has one online that you could print off. However I noticed a lot have online forms which doesn't really help.

  • Havent seen claim forms being routinely used in private motor since the early 90s and even then it was only the policyholder/ first party that completes one for the insurer.

    You would send a letter of claim to them breaking down what you are claiming into individual items with values and enclose with it any photocopies of evidence to prove the valuations.

    Remember that you arent claiming off of your home insurance and so the valuations should be their value at the time of the incident not the cost of them brand new.
