This is my first post and I am sorry if this question has been asked before.

I am confused. :confused:

We are thinking about applying for our disabled son to go into residential accommodation. At the moment he receives higher rate DLA (has the car) and Incapacity Benefit. He receives ILF for the day servers that he uses which he pays a small amount to.

What we are confused about is what benefits would he lose or keep?

We have been told so far by social work (scotland) that we maybe able to keep his mobility car but would have to give up the rest of his benefits.

Is this true?

Can anybody help clear this matter up or direct us to a place that can. (as long as is not social work).

    The Disability Alliance Website looks like it might have some answers, though I haven't time to check it. I think he will lose DLA but not straight away if I remember right. I'm not sure about Incapacity Benefit. The Citizens Advice website - Adviceguide says: "However, the benefit is affected if you go into hospital, and for the care component if you go into a care home or other residential accommodation that is state funded." regarding DLA.

    There is a helpline you can call (info from CAB site): "The Benefits Enquiry Line

    The Department for Work and Pensions (DWP) run a telephone helpline giving information on benefits for sick and disabled people, their representatives and carers. This is called the Benefits Enquiry Line (BEL). In Northern Ireland, the Benefits Enquiry Line is run by the Social Security Agency. The helpline also offers help filling out claim forms over the phone when you are applying for Disability Living Allowance and Attendance Allowance.

    You can contact the Benefits Enquiry Line on 0800 882200 (0800 220674 in Northern Ireland) or Minicom 0800 243355."

    as far as i am aware you will lose your money after 28 days unless he comes home at weekends they are not genorous enough to pay for his care as well as pay you. this is what it says in the back of my old book.

    Bonnie, I think that's true for the care component of DLA (which he must get to qualify for ILF) unless he's self-funded. Mobility component should be OK. But I'm unsure whether the rules are identical in Scotland/England. Incapacity benefit should be OK too.

    Best bet is probably a phone call to the CAB and make sure their info system is logged into the Scottish version.

  • If he's only on the Mobility component, then it shouldn't be affected unless he goes into hospital. If you want to ring someone then ring the DLA helpline. 0845 7123456
